<br />EXTRACT OF MINUTES <br />OF MEETING OF THE CITY COUNCil <br />OF THE CITY OF ROSEVlllE <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />... <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly held on the 29th day of June 1999, at 6:30 p.m. <br /> <br />The following members were present: Mastel, Wiski, Maschka <br />and the following were absent: Goedeke, Wall <br /> <br />Council Member Maschka introduced the following resolution and moved its adoption: <br /> <br />Resolution No. 9663A <br />Resolution Approving a Three (3) Foot Side Yard Driveway Setback <br />At 2687 Woodbridge Street <br /> <br />WHEREAS, Section 703.04B(9) of the Roseville City Code states: Residential driveways, <br />shall be constructed so that the edge of the driveway nearest the side lot line shall be a minimum <br />of five (5) feet from the side lot line; and <br /> <br />WHEREAS, The City's Pavement Management Program and the reconstruction of <br />Woodbridge Street have prompted the variance request; and <br /> <br />WHEREAS, the Roseville Planning Commission conducted a public hearing on a request <br />for a five (5) foot wide variance to the side yard setback requirement on Wednesday, June 9, 1999, <br />and recommended (5-1) denial of the requested variance; and <br /> <br />WHEREAS, the Roseville City Council received the Planning Commission's <br />recommendation on Tuesday, June 29, 1999; and <br /> <br />WHEREAS, the Roseville City Council made the following findings: <br /> <br />1. Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate <br />that no practical alternatives exist that would reduce the need for a variance. <br /> <br />2. Records indicate that building permits were issued to a previous owner in 1983 for <br />remodeling the attached garage and for construction of the detached garage, however no <br />records are on file regarding the existing paved driveway surface. <br /> <br />3. Given the design of the driveway and its distance from the existing home to the property <br />line, a three (3) foot wide variance would provide ample width to maneuver a vehicle to <br />the rear detached garage. <br /> <br />4. A three (3) foot wide variance provides two (2) feet of green area (upon reconstruction) <br />that will act as a drainage swale, providing improved water quality and quantity control. <br />
