<br />· <br /> <br />EXTRACT OF MINUTES <br />OF MEETING OF THE CITY COUNCIL <br />OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly held on the 12th day of July, 1999, at 6:30 p.m. <br /> <br />The following members were present: Mastel, Wiski, Goedeke, Wall, Maschka (8:25pm) <br />and the following were absent: None <br /> <br />Council Member Wall introduced the following resolution and moved its adoption: <br /> <br />Resolution No. 9667 <br />Resolution Granting An Excavation Permit At <br />2775 Vidoria Street <br /> <br />WHEREAS, Section 705.01B of the Roseville City Code requires City Council review and <br />approval of excavation permits when the undeveloped 1 acre (or less) site, located in an "R-1" <br />zone, is proposed to be excavated or filled by 2,000 cubic yards or more; and <br /> <br />WHEREAS, Innovative Designs and Gary Excavating (contractor) have requested an <br />excavation permit to remove up to 5,000 cubic yards of soil from a vacant lot located at 2775 <br />Victoria Street, legally described as the following property: <br /> <br />Section 2 Town 29 Range 23 ex W 395 ft. part lying westerly of CIL of <br />Victoria Street ofN 100 ft ofS 200 ft of govt.lot 3 (subject to Rd) in <br />Sec 02 T 29 R 23 (PIN022923310056) <br /> <br />WHEREAS, the Roseville City Council received the application and staff report on July 12, <br />1999; and, <br /> <br />WHEREAS, the Roseville City Council made the following findings: <br /> <br />1. The steep topography of the parcel creates a physical hardship for the applicant, <br />as it requires re-grading of the site and an extended driveway to reduce the slope <br />of the driveway on the site. The re-grading of the site will undoubtedly have an <br />adverse impact on the lot's mature stands oftrees. <br /> <br />2. The excavation is in harmony with the existing development in the area, the <br />general purpose and intent ofthe City's Comprehensive Plan and Title 10 of the <br />City Code (Zoning). <br /> <br />3. The proposed permit, if granted, will not adversely affect the public health, safety, <br />or general welfare. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that an excavation permit to <br />
