1 would be to provide the tenant head of household with the identification of <br />2 the number of ndults and children (related and unrelated) living in the unit. <br />3 City nttorney notes that nsking for the information is not a data privacy <br />4 issues but it would become a data privacy issues if the information wns <br />5 requested by someone other thnn for internal city use of which the City <br />6 processes for reviewing such issues would protect individunl privacy of the <br />7 tenants. Knowing the numbers of individuals within a rental unit is important <br />8 to enforce limits on overcrowding and nccurately address the numerous <br />9 complaints we get concerning overcrowding. Also, having the head-of- <br />10 household identified helps save staff time researching these individuals nnd <br />11 their phone numbers and therefore keeps costs down for the city by <br />12 enabling staff to address and resolve complaints more quickly. <br />13 <br />14 907.28: second sentence: Requirement thnt utility services be mnintained in <br />15 the nnme of the property owner? This was requested by utility billing to <br />16 address payment responsibility for unpaid bills nnd to alert property owners <br />17 of non pnyment before it gets out of hand nnd the tenant lenves the unit. <br />18 <br />19 907.15: Whnt happens under state law or this ordinance if the rental <br />20 property owner fails to designate u local agent, fails to mnintain the local <br />21 agent, or fails to update the city with information about the local agent? <br />22 Increase to the 13-county area. The City (Council or HRA) could provide n <br />30 waiver on penalty if the owner is making a good faith effort to resolve the <br />31 issues nnd evict the problem tenants who have broken the law. Also, the city <br />32 could provide owners with better tenant screening methods so the issue <br />33 does not reoccur. <br />34 <br />35 907.12: Violntion is subject to fine & imprisonment. This is too harsh. This <br />36 is standnrd complinnce langunge used by cities to encourage consistent <br />37 violators nnd only alwnys used as n last resort method. The act of writing a <br />38 citation is not a fine or imprisonment. Court citntions are written when there <br />39 is an imposse between the city and n property owner over an issue; the <br />40 property owner disngrees with the city's position or action.
