1�1i <br />J� <br />�"s'� a� , <br />Community Development Department <br />emo <br />To: Dennis Welsch, Community Development Director <br />From: Don Munson, Building Official <br />Date: O 1-23-2006 <br />Re: Property Maintenance Code — Responses to raised concerns <br />Concerns have been raised about: <br />• Overcealous enforcement: <br />o The Community Development Director, City Manager and ultimately City <br />Council have authority to interpret and direct the level of code enfarcement. <br />Staff can be directed and ordered to interpret and enforce the IPMC provisions <br />a specific way (unlike the building codes). <br />• Staff forcing their way into private homes: <br />o Staff has no authority to enter a private home without the homeowners <br />permission: <br />■ Staff can only enter a home with a search warrant issued by the court <br />(as is now the case). <br />■ Staff can only get a search warrant if an eyewitness testifies of a health <br />or life-safety issue inside a home, such as; a garbage house, <br />infestation, etc. (as is now the case). <br />o Renters can allow staff into a rental property when filing a complaint (as is <br />now the case). <br />o With the IPMC staff will have no additional authority to enter a private home. <br />• Page 1 <br />
