At such future time that it becomes necessary to acquire an additional 16.5 feet of right- of-way for Rice Street, the applicant agrees to provide the easement to the City. An agreement between the City and SuperAmerica shall be filed with the Ramsey County Recorder. The applicant understands that any and all site improvements will be removed by the applicant at such time at no cost to the City. Improvements shall include, but not be limited to, pazking surface, curbing, storm sewer and appurtenances, landscaping and signage. The applicant further agrees that no damages to the property or business will result from the taking of additional right-of-way and subsequent improvements. 2, The applicant shall provide monument signage along Rice Street with appropriate setbacks as ganted per the site plan presented to the City Council on April S, 1996. 3. Should the City deem it necessary, the appGcant will work with City staffto abate noise by providing additional sound deadening, removing noisy equipment, or changing hours of operation. riny and all costs associated with additional noise abatement shall be the responsibility of the applicant. 4. Site plan be modified to insure that the underground fuel tanks are at least 18-1/2 feet from Rice Street. 5. The applicant shall forthwith provide to the City a 10 foot utility and roadway easement along the entire length of the east property line at no cost to the City. 6. The applicant commits to work with Roseville City staff to resolve any future issues that may arise from the operation of this proposed facility. 7. All final application drawings shall become part of the permit. 8. The landscape plan shall be modified to emphasize evergreen plantings to insure adequate screening and yeaz round interest. 9. T'he applicant shall aclmowledge agreement with the conditions specified in this resolution by signing a copy of this resoludon and retuming it to the City. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Wiski and upon vote being taken thereon, the following voted in favor Wiski, Goedeke, Mastel, Wall and the following voted against the same: None.
