At such future time that it becomes necessary to acquire an additional 16.5 feet of right- <br />of-way for Rice Street, the applicant agrees to provide the easement to the City. An <br />agreement between the City and SuperAmerica shall be filed with the Ramsey County <br />Recorder. The applicant understands that any and all site improvements will be removed <br />by the applicant at such time at no cost to the City. Improvements shall include, but not <br />be limited to, pazking surface, curbing, storm sewer and appurtenances, landscaping and <br />signage. The applicant further agrees that no damages to the property or business will <br />result from the taking of additional right-of-way and subsequent improvements. <br />2, The applicant shall provide monument signage along Rice Street with appropriate setbacks <br />as ganted per the site plan presented to the City Council on April S, 1996. <br />3. Should the City deem it necessary, the appGcant will work with City staffto abate noise by <br />providing additional sound deadening, removing noisy equipment, or changing hours of <br />operation. riny and all costs associated with additional noise abatement shall be the <br />responsibility of the applicant. <br />4. Site plan be modified to insure that the underground fuel tanks are at least 18-1/2 feet <br />from Rice Street. <br />5. The applicant shall forthwith provide to the City a 10 foot utility and roadway easement <br />along the entire length of the east property line at no cost to the City. <br />6. The applicant commits to work with Roseville City staff to resolve any future issues that <br />may arise from the operation of this proposed facility. <br />7. All final application drawings shall become part of the permit. <br />8. The landscape plan shall be modified to emphasize evergreen plantings to insure adequate <br />screening and yeaz round interest. <br />9. T'he applicant shall aclmowledge agreement with the conditions specified in this resolution <br />by signing a copy of this resoludon and retuming it to the City. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Wiski and upon vote being taken thereon, the following voted in favor Wiski, Goedeke, <br />Mastel, Wall and the following voted against the same: None. <br />WI-IERE UPON, said resolution was declazed duly passed and adopted. <br />2 <br />
