REQUEST FOR VARIANCE BOARD ACTION <br />D�TE: 0�/03/O6 <br />ITEl�i NO: 4b <br />Department �pproval: Agenda Secrion: <br />BL/TRP PUBLIC HEARINGS <br />Item Description: George Schultz Trust driveway setback vatiance for property located at <br />597 South Owasso Boulevatd (PF3724). <br />1.0 REQUESTED ACTION: <br />1.1 The George Schultz Trust is requesting an 8-foot variance from Section 703.04 of the <br />City Code to reduce the required driveway access point setback from a street corner from <br />30 feet to 22 feet; <br />2.0 BACKGROUND: <br />2.1 The George Schultz Trust owns the property located at 597 South Owasso Boulevard. <br />The property is zoned R-1, Single Family Residential, and the Comprehensive Plan <br />identifies the property as Low Density Residential. <br />2.2 The City's Pavement Management Program and the reconstruction of South Owasso <br />Boulevard have prompted the variance request. <br />2.3 The proposed reduction of this setback would enable the George Schultz Trust to <br />maintain the driveway in its exact location. <br />3.0 STAFF COMMENT: <br />3.1 Section 703.04B(4) requires a minimum driveway access point setback from a street <br />corner of 30 feet. Based on the proposal, a variance is necessary to allow the existing <br />driveway to remain. <br />3.2 The Pavement Management Prograqi and its reconstruction of South Owasso Boulevard <br />have initiated this request. <br />3.3 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br />3.4 Relocating the access point to meet the 30 foot setback would require majoe <br />modifications to the irrigation system and the existing driveway a� it extends to the <br />garage. <br />3.5 The proposed variance, if granted, will not adversely affect the public health, safety, or <br />general welfare, provided standards/conditions are attached to ensure that future <br />redevelopment of the site is completed in accordance with the plans proposed by the <br />applicant at that time. <br />PF3724_RVBA_050306 Page 1 of 2 <br />
