REQUEST FOR VARIANCE BOARD ACTION <br />DATE: 05/03/O6 <br />ITEM NO: 4c <br />Department Approval: Agenda Section: <br />BL/TRP PUBLIC HEARINGS <br />Item Description: Robert Muchow driveway setback variance for property located at 1511 <br />Roselawn Avenue (PF3726). <br />1.0 REQUESTED ACTION: <br />1.1 Robert Muchow is requesting a 25-foot variance from Section 703.04 of the City Code to <br />reduce the required driveway access point setback from a street corner from 30 feet to 5 <br />feet. <br />2.0 BACKGROUND: <br />2.1 Robert Muchow owns the property located at 1511 Roselawn Avenue. The property is <br />zoned R-1, Single Family Residential, and the Comprehensive Plan identifies the property <br />as Low Density Residential. <br />2.2 The City's Pavement Management Program and the reconstruction of Roselawn Avenue <br />have prompted the variance request. <br />2.3 The proposed reduction of this setback would enable Robert Muchow to maintain the <br />driveway in its exact location. <br />3.0 STAFF COMMENT: <br />3.1 Section 703.04B(4) requires a minimum driveway access point setback from a street <br />corner of 30 feet. Based on the proposal, a variance is necessary to allow the existing <br />driveway to remain. <br />3.2 The Pavement Management Program and its reconstruction of Roselawn Avenue have <br />initiated this request. <br />3.3 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br />3.4 Relocating the access point to meet the 30 foot setback would require major <br />modifications to the existing driveway as it extends to the garage. <br />3.5 The proposed variance, if granted, will not adversely affect the public health, safety, or <br />general welfare, provided standards/conditions are attached to ensure that future <br />redevelopment of the site is completed in accordance with the plans proposed by the <br />applicant at that time. <br />PF3726_RVBA_050306.docPage 1 of 2 <br />
