ORDINANCE NO. 1279 AN ORDINANCE AMENDING TTTLE 10, SECTION 1002, DEFINITIONS AND SECTION 1005, BUSINESS DISTRICTS SPECIFICLY REGARDING RESTAURANTS THE CITY OF ROSEVILLE ORDAINS: SECTION 1. Purpose. The Roseville City Code, Title 10, Section 1002 and 1005, is hereby amended by adding or revising language necessary to define restaurant types and to specify which restaurants aze permissible (permitted and/or conditional) within Business Dishicts of the Roseville City Code. The purpose of this ordinance is to provide clarity regazding restaurant types and to locate said types within the most appropriate Business District. SECTION 2. Section 1002.02 (Definitions) is hereby amended. The existing "RestauranY' definition is hereby deleted and replaced with the following: A. Restaurant, Class I— Traditlonal: An establishment where customers aze served their food in or on non-disposable dishes to be consumed primarily while seated at tables or booths within a building and which does not serve liquor. Traditional restaurants may also be a caf8, cafeteria or buffet, coffee shop, and/or deli. Drive- through facilities aze not allowed. B Restaurant, Class II — Fast Food Convenience: An establishment where customers are served their food from a counter or in a motor vehicle, in disposable packages prepazed to leave the premises or to be taken to a table or booth for consumption on the premises. Fast Food Convenience can be a caf8, coffee shop, and/or deli. Fast Food Convenience can include drive-through facilities. C. Restaurant, Class III — Traditional w/Intoxicating/Non-Intoxicating (3.2 beer, wine and/or strong beer): An establishment where customers aze served their food in or on non-disposable dishes to be consumed primarily wlule seated at tables or booths within a building and wluch has a license to serve only beer and wine. D. Restaurant, Class IV — Traditional w/On-Sale Liquor Service (full service bar): An establishment where customers aze served their food in or on non- within a building that is licensed to serve on-sale liquor which aze consumed on the premises. This type of restaurant may offer as an accessory use take-out and /or deli facilities, live entertainment or dancing. E. Restaurant, Class V— Drlvc-In: An establishment that serves food in or on either disposable or non-disposable dishes where customers primarily order and consume food within their vehicles.
