A. Setback Requirements shal] be as established in the above chart (Section 1005.01) unless specified <br />differently in this subsectian: <br />1. Front Yazd Setback: Where adjacrnt structures have front yard setbacks different from those required, the <br />front yazd setback shall conform to the average setback of the adjacent structures. If only one adjacent lot is <br />occupied by a struchue, the front yard setback shall be the aveiage of the required setback and the setback <br />of that adjacent structure. (Ord. 275, 5-12-1959) <br />2. Side Yard Setback:. When a side yard adjoins a residential dish-ict, the setback shall not be used for <br />pazldng or loading. Where a side yazd faces a s7eet (corner lot), the side yazd setback shall be thirty feet <br />(30�. Where such a corner lot side yazd faces a residential district across the street, screening shall be <br />provided as specified in subsection G of this Section. (Ord. 878, 3-23-1981) <br />3. Rear Yard Setback; Screen Wall. Where the rear yard adjoins a residential district, a screen wall of six <br />feet (6') but not more than eight feet (8') in height shall be installed and maintained by the owner of the <br />business parcel to effectively inhibit eye ]evel vision between residential and business areas. <br />B. Floor Area Ratio: Subject to all other provisions of the code and setbacks, the floor azea of <br />building and lot azea in all business districts shall not be greater than 1.0. Enclosure Of Certain Businesses Required: <br />1. All business, storage, service, repair, processing or merchandising display shall be conducted wholly <br />within a building or be}und a solid fence not less than six and one half feet (6'- 6") or nor more than eight <br />feet (8') high adjacent to residrntial districts to completcly screen the acrivity or storage, except for the <br />following uses and in accordance with the conditions herein specified. <br />a. Off-street parldng and loading where permitted as accessory uses. <br />b. Display of automobiles and trucks whece accessory to authorized principal uses. (Ord. 1091, 5-28- <br />1991; amd. 1995 Code) <br />2. Temporary outside display and sale of inerchandise outside a building or protective structure may be <br />established for up to thirty (30) cansecutive calendar days a yeaz after the issuance of a temporary <br />display/sales permit by the Community Development Director or designee, using the criteria set Forth in <br />subsecrion 3 below in any of the following business districts where retail sales ate allowed: B-2, B-3, B� <br />and shopping center dish-icu. A single temporary display sign per tenant, not to exceed twenty (20) square <br />feet, within ten feet (10� of the sales azea, and with property owner approval, may be placed on a wall or <br />solid surface for the thirty (30) day temporary sale. A site plan indicating the location of the sales azea and <br />sign shall be provided to the city for review and approval. <br />3. Incidental or seasonal sales, such as produce, nursery, or greenhouse sales, including an accessory <br />struchue may be permitted after issuance of a seasonal sales permit for a period not to exceed ninety (90) <br />calendar days, after review of the following criteria submitted with the permit application: <br />a. The amount of ouuide sales area compazed to the amount of inside sales space. <br />b. Locarion of the ouuide sales area and the extent it encroaches on required setbacks. <br />c. Impact on trafiic, pedestrian circulation, and emergency response on the site. <br />d. Impact on pazldng on the site. <br />e. The height of inerchandise displays. <br />f. The hours which merchandise is displayed. <br />g. The type of inerchandise to be displayed. <br />h. Incidental or seasonal display signage, to a m�ucimum of seventy five (75) square feet in azea, shall be <br />placed on a solid surFace or attached to a solid surface for the term of the display. <br />i. Accessory structures used in incidental or seasonal displays shall meet all applicable fue codes and <br />pazldng lot setback requirements. (Ord. 1238, 3-13-2000) <br />4. The outside display of inerchandise, except as covered in subsections El E2, and E3 of this section, is <br />permitted by conditional use permit.
