2003 Code Modification: <br />2.4 In 2002 the Plaruling Division experienced of number of issues/concerns regarding <br />restaurants located along Perimeter Drive. Specifically, these restaurants (10) were zoned <br />Limited Retail District (B-1B) a zone that did not permit restaurants. The City Planner <br />completed a further review of other restaurants and their zoning, concluding that a zoning <br />text amendment was necessary. <br />2.5 In February 2003, the City Council approved zoning text amendments (specific to Section <br />1002 Definitions and 1005 Business Districts) clarifying types of restaurants and the zones <br />within which they were to be pemutted and conditional. This amendment specifically <br />established a class system of restaurants and assigned them within the various Business <br />District zoning classifications. The goal was to allow restaurants similar to (at that time) the <br />current code. The process was slightly complex because it required the City Planner to <br />redefine restaurants based on the class system versus the code allowance. For example, the <br />B-4, Retail Office Service District allowed restaurants over 5,000 sq. ft. as a pernutted use. <br />2.6 Ordinance 1279 was approved by the City Council, which ordinance created 6 different types <br />of restaurant classes and a matrix that identified e�cisting and proposed language regarding <br />restaurants (see attached). <br />2004 Code Modification: <br />2.7 In 2004 the Community Development Department began the amendment process for Section <br />1005, Business Districts of the Roseville City Code. Specifically, the goal was to update and <br />clarify certain aspects of the Business Districts section and to take a11 uses (permitted and <br />conditional) and insert them into a chart for ease of locating and understanding. The <br />amendment process also included revisions to district purpose statements and a review and <br />modification (elimination/addition) of uses. <br />2.8 The 2004 purpose statement for the B-4 District was modified to read as follows: <br />a. "The B-4, Retail office Service District is designed to provide a limited mix of land <br />uses, made compatible through controls of high quality standards, to facilitate more <br />intensive, larger, and higher value development and redevelopment areas far the <br />regional market. This district allows opportunities to integrate high quality offices, <br />hotels, restaurants, retail uses and selected office and manufacturing uses visible from <br />state or county roads. The B-4 Retail Office Service District in intended for certain <br />areas designated as B, Business within the Comprehensive Plan". <br />b. Ordinance 1305 created the current requirements within the Business Districts <br />section of the City Code (attached) which inadvertently omitted a number of <br />restaurants from the B-4 District. <br />2 <br />
