3.0 REVIEW of REQUEST: <br />3.1 Over the past couple of years, the Community Development Department has encountered a <br />few "codification" errors — where requirements addressed in the code have been mistakenly <br />omitted from a chart. This most recent item seeks to include the appropriate restaurant types <br />within the B-4 zone via the chart identified in Section 1005.015 of the City Code. <br />3.2 When the City Planner encountered a request seeking the allowance of a restaurant in a B-4 <br />zone, the initial reaction was that of an omission when uses were converted from text to a <br />chart in 2004. <br />3.3 However, a review of the historical actions pertaiiung to the Business Districts section of the <br />Roseville City Code related to restaurants concludes that the allowance of Class III - <br />Traditional w/Intoxicating/Non-Intoxication (3.2 beer, wine and/or strong beer) as a <br />permitted use was inadvertently omitted during the initia12003 amendment. Further, the <br />allowance of a Class IV — Traditional w/On-Sale Liquar Service (full service bar) without <br />live entertainment and dancing as a pernutted use and as a conditional use with live <br />entertainment and dancing was inadvertently omitted in the 2004 chart creation. <br />3.4 Contrary to the previous request of May 8, 2006, a Class I- Traditional restaurant is already <br />permitted within the B-4 District. As well, a Class IV - Traditional w/On-Sale Liquor <br />Service w/live entertainment & dancing should be allowed through the conditional use <br />pernut process versus being permitted as originally requested. <br />3.5 In summary, the City Planner seeks to modify the chart located in Section 1005.015 of the <br />Roseville City Code to meet the purpose and intent of previous approvals by the City <br />Council pertaining to restaurants within the B-4 zoning district. <br />4.0 STAFF RECONIMENDATIONS: <br />4.1 The City Planner recommends that the City Council support the inclusion of a Class III — <br />Traditional w/Intoxicating/Non-Intoxication (3.2 beer, wine and/or strong beer) as a <br />PERMITTED USE; a Class N— Traditional w/On-Sale Liquor Service (full service bar) <br />with takeout/deli as accessory use — no live entertainment or dancing as a PERMITTED <br />USE; and a Class N— Traditional w/On-Sa1e Liquor Service (full service bar) with live <br />entertaiiunent or dancing as a CONDITIONAL USE. <br />5.0 SUGGESTED ACTION: <br />5.1 BY MOTION, APPROVE the change in the Business District chart (Section 1005.015) <br />pertaining to restaurants — specifically allowing a Class III — Traditional <br />w/Intoxicating/Non-Intoxication (3.2 beer, wine and/or strong beer) as a PERMITTED <br />USE; a Class IV — Traditional w/On-Sale Liquor Service (full service bar) with <br />takeout/deli as accessory use — no live entertainment or dancing as a PERMITTED <br />USE; and a Class IV — Traditional w/On-Sale Liquor Service (full service bar) with live <br />entertainment or dancing as a CONDITIONAL USE. <br />
