WHEREAS, Section 1005.01 requires a minimum 30-foot setback for structures (e.g., pylon signs) from public rights-of-way; and WHEREAS, Section 1012.03 requires a minimum 40-foot "visibility triangle" at intersections; and WHEREAS, Croix Oil Company seeks to construct a pylon sign within the required "visibility triangle"; and WHEREAS, the Planning Division has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code if the conditions identified below are met; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a VARIANCE to § 1012.03 (Traffic Visibility) to allow a pylon sign within the "visibility triangle" and a VARIANCE to § 1005.01 (General Requirements in Business Districts) to allow the construction of a pylon sign in a location not less than 5 feet from the County Road B right-of- way and not less than 5 feet from the Dale Street right-of-way, subject to the following conditions: 1. The applicant must work with the City Engineer to select a satisfactory location for the sign such that the sign is not positioned too near the storm sewer and not closer than 5 feet from any right-of-way. 2. The variance shall expire within 6 months of its approval if a sign permit is not issued pursuant to § 1013.03 of the City Code. The motion for the adoption of the foregoing resolution was duly seconded by Variance Board Member poherty and upon vote being taken thereon, the following voted in favor: Members Bakeman, Boerigter, and Doherty; and none voted against; WHEREUPON said resolution was declared duly passed and adopted.
