Thomas McDaniel originally fled an appeal to a Variance Board decision, <br />which was presenfed and reviewed at the Oct 23, 2006 City Council meeting. At the Oct 23 <br />meeting, the Council decision was to grant a continuation to further clarify the conflicting dat� <br />that was presented at that time. <br />The points below will hapefully clarify the somewhat complicated situation. <br />Original Property Situation <br />The MeDaniel's purchased the lot at 527 Owasso Hills Dr in 1996. At this time the outlot <br />area behind the building area consisted of two distinct ponds and a"wetland" area. The t�tio <br />ponds were specifically constructed when the neighborhood was developed for storm water <br />retention. The "wetland" azea between the ponds was partially on our property. We were <br />properly informed that the wetland existed on the property and of the 50 foot setback <br />requirement. Fn fact, when the property was purchased, a form was signed to document the <br />acknowledgement of the wetland and the 50 foot setback requirements. <br />Original Wetland Boundary <br />There were two drawings presented to the McDaniel's during the lot purchase and home <br />build processes which documented the borders of the property and the wetland location. <br />One was the platt drawing used by the Developer (and all three builders) within the Owasso <br />Hills neighborhood. The other was the formal Certificate of Survey for the property at 527 <br />Owasso Hills. These two drawings (attached) are consistent in terms of delineating the <br />original wetland boundary in the northwest corner of the 527 property. According to these <br />two drawings, the closest wetland boundary would be at least 75 feet from the proposed 250 <br />sq ft addition to the existing home. <br />Roseville City Staff presented another drawing showing the wettand boundary (attached). <br />This version is verv inconsistent with the other two documents mentioned and shows a much <br />larger wetland. This drawing was generated by an architectural firm (Schoell Madson) in <br />1995. Per ihe Schoell Madson drawing, the wetland area is so large that the existing home <br />at 527 Owasso Hills is basically right up against the 50 foot setback. <br />So, as highlighted in the Oct 23, 2006 City Council meeting, there remains conflicting data <br />relative to the original "wetland" boundary. <br />Attachment A: Page 1 of 9 <br />
