3.0 SUGGESTED COUNTIL ACTION
3.1 The City Counci has two options pertaining to the VARIANCE APPEAL by Mr.
 McDaniel:
-t a. The Council can uphold the Variance Board's decision of October 4, 2006 to deny the
requested variance, concluding that no hardships are present to warrant granting a
c variance. To act on this decision the City Council could ADOPT a RESOLUTION
- DENYING a VARIANCE to Section 1016. 16 (Wetland Setbacks) of the City
` Code. This action will require findings of fact denying said request (see Attachment
 B: Draft Concurring Resolution).
t ci b. The Council can support the applicant's request, determining that hardships are
present that warrant granting a variance. To act on this decision the City Council
i? could ADOPT a RESOLUTION APPROVING a 15 foot VARIANCE to Section
1016. 16 (Wetland Setbacks) of the City Code (see Attachment C: Draft Variance
1-t Approval Resolution).
Prepared by: Associate Planner Bryan Lloyd (651-792-7073)
Attachments: A: New information from Thomas McDaniel
B: RCA packet from October 23, 2006 Ciry Council meeting
C: Minutes of October 23, 2006 City Council meeting
D: Draft Concurring Resolution
E: Draft Variance Approval Resolution
PF 3 7 8 7_RCA_Appeal_022607
