4.0 BACKGROUND: <br />4.1 In June 2001, the Roseville City Council unanimously approved a new 280-acre Master <br />Plan and Renewal Strategy as well as an Alternate Urban Area Wide Review for the <br />entire Twin lakes Redevelopment Area from approximately Cleveland (west) to Lincoln <br />Drive (east) and from County Road C(south) to County Road C-2 (north). The City <br />Council's action included a resolution approving an amendment to the Roseville <br />Comprehensive Plan that established the Twin Lakes Redevelopment Area as Business <br />Park (BP). <br />4.2 In December 2003, the Roseville City Council selected Rottlund Homes as the Twin <br />Lakes Master Developer. From February through July the Master Developer worked <br />with the Council selected Stakeholders Panel to review and refine the Master Developer <br />concepts. <br />4.3 In September 2004, Rottlund submitted an application (concept) for approval of an 80 <br />acre mixed residential and retail/office General Concept Planned Unit Development to <br />redevelop a portion of the Twin Lakes truck terminal area to be known as Phase 1 of <br />Twin Lakes Redevelopment. <br />4.4 In October 2004, the Roseville Planning Commission considered the proposed Twin <br />Lakes Master Plan Amendment, Preliminary Plat, Rezoning, and General Concept Plan, <br />recommending approval of the plan/project. <br />4.5 In January 2005, the Roseville City Council approved the General Concept Plan and all <br />other supporting actions related to the Phase I Redevelopment. <br />4.6 In June 2005, the Roseville City Council approved the Final Development Plan and all <br />other supportive actions related to the Phase I Redevelopment. <br />4.7 On August 10, 2006, the Minnesota Court of Appeals concluded that the 2005 Master <br />Plan Amendment effectively served to amend the Comprehensive Plan, but did not <br />achieve the required supermajority vote (4/5) of the City Council. <br />4.8 On October 6, 2006, the City Planner received and accepted muhiple applications from <br />Rottlund Company, Inc. to redevelop approximately 58 acres within the Twin Lakes <br />Redevelopment Area in a manner that the developer deemed consistent with the 2001 <br />Master Plan. <br />5.0 COMPREHENSIVE PLAN REVIEW: <br />5.1 Minnesota State Statute 473.865 subdivision (2) states, in part, "A local governmental unit <br />shall not adopt any official control... which is in conflict with its comprehensive plan." <br />For the purposes of reviewing and potentially approving this land-use application, the City <br />of Roseville must determine whether the amendments sought to the official controls <br />(rezoning, platting, vacations, etc.) do not conflict with our Comprehensive Plan. <br />PF3790_RPCA_GeneralConcept_l 10106 Page 2 of 14 <br />
