4. The construction of the four-story office building as proposed will not have an adverse
impact on the general public health, safety and welfare.

5. A revised development plan submittal will be required for review and approval by staff and
is necessary prior to the completion of the PUD Agreement and final consideration by the
City Council.

Based on the findings outlined above, the Planning Commission recommended approval of the
request to amend the PUD #1224 to allow the design and construction of a four-story office/radio
building totaling 40,000 square feet and a single story parking deck with the following conditions:

1. The site must be developed in accordance with the staff corrected plans submitted and
approved in conjunction with the request for an amendment to the approved planned unit
development (site plan; grading, drainage, erosion control, & utilities plan; concept
landscape plan; building floor plan; and exterior building elevations all dated 08/26/99).
Minor variations from the approved site plan may be approved by the City's Development
Review Committee, under the direction of the Community Development Director. However,
any substantial departures from the approved site plan will require another amendment to the
planned unit development.

2. Final grading, storm sewer, and utility plans must be reviewed and approved by the City
Engineer/Public Works Director. Rice Creek Watershed District shall review and comment
on the proposed grading/drainage plan.

3. A final landscape plan must be submitted to the City Landscape Architect for review and
approval.

4. The erosion control plan must be submitted in conjunction with site development plan.

5. The building design and materials must be consistent with the neighborhood, PUD, and
College nearby buildings.

NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of
Roseville, Minnesota (the "City"), Ramsey County, Minnesota, hereby approves the concept of the
PUD amendment for Northwestern College as stated above and with the findings and conditions as
recommended by the Planning Commission (listed above) on September 8, 1999.

The motion for the adoption of the foregoing resolution was dilly seconded by Council
Member Wiski and upon vote being taken thereon, the following voted in favor: Maschka, Mastel,
Goedeke, Wiski
and the following voted against the same: None

WHEREUPON said resolution was declared duly passed and adopted.

Resolution #9687, Northwester College (PF3144) Page 2 of 3
