CHAPTER 1009 <br />OVERLAY DISTRICTS <br />SECTON: <br />1009.01: Purpose <br />1009.02: Establishment of Districts <br />1009.03: Applicability and Interpretation <br />1009.04: Single-Family Residential Overlay District (SFROD) <br />1009.01: PURPOSE: <br />To provide overlay zoning districts that additionally regulate uses and characteristics of uses permitted in <br />primary zoning districts as deemed in the public interest. <br />1009.02: ESTABLISHMENT OF DISTRICTS: <br />The following overlay district is hereby established: <br />A. Single-Family Residential Overlay District <br />1009.03: APPLICABILITY AND INTERPRETATION: <br />All provisions of the Zoning Code shall apply to the overlay zoning districts; however, in any instance where <br />the provisions of an overlay zoning district shall conflict with the provisions of a primary zoning district, the <br />provisions of the overlay zoning district shall take precedence and govern. <br />1009.04: SINGLE-FAMILY RESIDENTIAL OVERLAY DISTRICT (SFROD) <br />A. Purpose: The purpose of the Single-Family Residential Overlay District is to permit utilization of <br />isolated recorded lots that were platted on or before May 21, 1959, that do not meet, but are within 70 % <br />of the R-1 Single-Family Residential width, area, and/or open space requirements as adopted within this <br />Code so long as reasonable living standards can be provided. <br />B. Permitted Uses: Permitted uses in the SFROD are the same as those within the R-1 District. See Section <br />1004.02(A). <br />C. Permitted Accessory Uses: Permitted accessory uses in the SFROD are the same as those within the R-1 <br />District. See Section 1004.02(B). <br />D. Uses Allowed by Conditional Use Permit: Conditional uses in the SFROD are the same as those for R-1 <br />District. See Section 1004.02(C). <br />E. Dwelling Dimensions and Appearances and Height, Frontage Yard and Lot Area Requirements in <br />SFROD: See Section 1004.016 <br />1. On a lot without a garage, a house shall be situated on the lot to provide adequate space for a two <br />vehicle garage meeting all required setbacks and size limitations. <br />2. Garages attached to a principle structure shall be constructed in a fully enclosed manner and provide a <br />door capable of admitting and enclosing a standard sized motor vehicle. <br />F. Contiguous Substandard Lots/Common Ownership: Where two or more contiguous lots are held in <br />common ownership within a subdivision that was duly recorded on or before 1VIay 21, 1959, and the lots <br />.�. —� <br />
