19 4.0 BACKGROUND <br />20 4.1 In 2004, Roseville's City Council enacted a moratorium on new outdoor storage uses in <br />z� the Twin Lakes redevelopment area, which included the subject property. Although the <br />22 moratorium did not specifically target such uses on this property, 1705 County Road C <br />2:� fell within the redevelopment area; consequently, Glenn Kloskin of Boater's Outlet could <br />2a not apply for the permanent conditional use approval. Instead, the only option for <br />2� allowing the outdoor storage of boats in this location was to approve it temporarily with <br />2s an Interim Use Permit. The moratorium has since been rescinded. <br />2� <br />2� <br />29 <br />30 <br />31 <br />32 <br />4.2 While the approved Interim Use Permit expired in 2007, Boater's Outlet has continued to <br />operate without incident until today. Planning Division staff has been aware of the fact <br />that the outdoor storage of boats has been a nonconforming use since 2007, but has not <br />had the opportunity until recently to inform Mr. Kloskin that his previous approval was, <br />by nature, temporary and that he needs to receive permanent approval of the CotvD�T�oNAL <br />usE in order to bring the Boater's Outlet use into compliance with the zoning ordinance. <br />3:� 4.3 This coNDiTioNaL usE request has been prompted by the applicant's desire to continue <br />34 storing boats outside both for customers whose boats are awaiting repairs and the <br />35 seasonal storage of boats over the winter. <br />36 $.0 <br />3� 5.1 <br />3 �3 <br />STAFF COMMENTS <br />Section 1007.015 (Industrial Uses) of the City Code permits outdoor storage as a <br />CotvD�T�oNAL uSE in the applicable General Industrial (I-2) District. <br />3y 5.2 Section 1013.01 (Conditional Uses) of the City Code requires the Planning Commission <br />ao and City Council to consider the following criteria when reviewing a cotv��T�otvAL usE <br />a � application: <br />a2 a. <br />43 b. <br />44 C. <br />45 <br />a6 d. <br />a � e. <br />a� f. <br />Impact on traffic; <br />Impact on parks, streets, and other public facilities; <br />Compatibility of the site plan, internal traffic circulation, landscaping, and <br />structures with contiguous properties; <br />Impact of the use on the market value of contiguous properties; <br />Impact on the general public health, safety, and welfare; and <br />Compatibility with the City's Comprehensive Plan. <br />4y Because consideration of these criteria is not a requirement of approving the previous <br />50 Interim Use Permit they have not been formally evaluated as they are in CoND�T�o1vAL usE <br />� � requests. Instead of prospectively assessing the potential impact of a proposed use on <br />52 each of the above criteria, Planning Division staff has reviewed its records pertaining to <br />53 the Boater's Outlet use at this property during the past several years and determined that it <br />5� has had (and is expected in the future to have) no negative impacts on the external <br />55 criteria. <br />56 5.3 With respect to the more internal site considerations of criteria "c", the aerial photo <br />57 (included with this staff report as Attachment B) shows that the boats are tightly arranged <br />53 in the storage area of the parcel, and Mr. Kloskin proposes to continue this arrangement. <br />5� Roseville's Fire Marshal has confirmed that he does not have any concern about the <br />PF09-025 RCA 102609 <br />Page 2 of 3 <br />� � <br />
