-�. _^ <br />98 MOTION <br />99 Member Boerigter moved, seconded by Member Wozniak to RECOMMEND APPROVAL OF A <br />100 REZONING for Michael Schueller and the owners of the property at 1901 Lexington Avenue from the <br />101 existing B-1 (Limited Business) Zoning District to the proposed B-1 B(Limited Retail) Zoning District, <br />102 based on the comments and findings of the Sections 6 and 6 of the project report dated December 5, <br />103 2007; noting that rezoning approval requires, prior to occupation, that the conditions of the existing <br />104 Conditional Use Permit, as indicated in City Council Resolution No. 89-14, be complied with, based on <br />105 staff research and findings, and as a stand-alone requirement (i.e., removal of parking areas along <br />106 Autumn Street and enclosed trash area). <br />107 Ayes:S <br />108 Nays: 2 (Gottfried; Doherty) <br />109 Motion carried. <br />110 MOTION <br />111 Member Boerigter moved, seconded by Member Wozniak to RECOMMEND APPROVAL OF A <br />112 CONDITIONAL USE PERMIT (CUP) for Michael Schueller and the owners of the property at 1901 <br />113 Lexington Avenue to allow a catering facility, based on the comments and findings of Sections 5, 6 <br />114 and 7 of the project report dated December 5, 2007; amended as follows: <br />115 • Additional condition that the applicant will work with staff and provide a landscape plan within the <br />116 area, including grass and other site amenities, to provide "green" screening to screen the <br />117 residential homes; and to ensure that the traffic visibility triangle addressed in code was <br />118 accommodated to avoid any blocking, as per code requirements. <br />119 Ayes: 5 <br />120 Nays: 2 (Gottfried; Doherty) <br />121 Motion carried. <br />122 Chair Bakeman advised that the Case was scheduled to be heard by the City Council at their January 14, <br />123 2008 meeting. <br />Page 3 of 3 <br />
