Attachment E <br />EJ10,2013MM <br />XTRACT OF THE ULYEETINGINUTES OF THE <br />RPC <br />OSEVILLE LANNING OMMISSION <br />5.Public Hearings <br />Chair Gisselquist reviewed the protocol for Public Hearings and subsequent process. <br />a.PLANNING FILE 13-008 <br />Request by Kath Oil for an EASEMENT VACATION to vacate an existing <br />utility and drainage easement at 2645 Snelling Avenue and to re-establish an <br />easement as a component of the site redevelopment and sanitary sewer <br />relocation <br />Chair Gisselquist opened the Public Hearing for Planning File 13-008 at <br />approximately 6:34 p.m. <br />City Planner Thomas Paschke summarized the request of Kath Oil for vacation of <br />a portion of the existing sanitary sewer easement that crosses current Marathon <br />gas station parcel in order to redevelop the site in to a new Holiday Gas Station as <br />detailed in the staff report dated July 10, 2013. <br />Mr. Paschke advised that he had spoken with Kath’s consulting engineer by <br />phone earlier today, who would not be available to attend tonight’s meeting. <br />Anticipating no outstanding issues, Mr. Paschke advised that no other <br />representatives from Kath were present either. <br />Member Daire confirmed the location of the vacation easement farthest north on <br />the property; and sewer line being gravity fed to the best of Mr. Paschke’s <br />knowledge. <br />Chair Gisselquist closed the Public Hearing at approximately 6:40 p.m.; with no <br />one appearing for or against <br />MOTION <br />Member Murphy moved, seconded by Member Stellmach to recommend to <br />the City Council APPROVAL of the VACATION of the sanitary sewer <br />easement at 2645 Snelling Avenue as described on Easement Vacation Survey <br />document dated June 6, 2013 (Attachment C); based on the comments and <br />findings of Sections 4-6 and the recommendation of Section 7 of the staff <br />report dated July 10, 2013. <br />Ayes: 6 <br />Nays: 0 <br />Motion carried. <br /> <br />
