REQUEST FOR COUNCIL ACTION <br /> Date: 8/12/13 <br /> Item No.:7.j <br />Department Approval City Manager Approval <br />Item Description: Approve Public Improvement Easement and Maintenance Agreement and <br />Rice Creek Watershed District Maintenance Agreement for Stormwater <br />Management Facilities for Josephine Heights (PF 13-005) <br />Page 1 of 2 <br />B ACKGROUND 1 <br />The City Council has approved the redevelopmen t of the property on Millwood Avenue between 2 <br />Victoria and Chatsworth Streets to develop 6 one-family residential lots around a short cul-de-sac 3 <br />street. As a part of this development Landm ark 6 Roseville, LLC will be constructing a public 4 <br />street, watermain, sanitary sewer, and storm sewer. 5 <br />The final plat and public improvement contract were approved by the City Council on July 22, 2013. 6 <br />To address storm water runoff, the Developer will be constructing bio-retention ponds on Outlot A 7 <br />and Outlot B. These outlots and ponds will become the responsibility of the City of Roseville. 8 <br />The Developer desires to plant these bio-retention ponds to create an amenity to the development. 9 <br />Planted infiltration basins require regular maintenance, including weeding, mulching and 10 <br />replacement of plants. As described in the Public Improvement Easement and Maintenance 11 <br />Agreement the maintenance of the private landscaping will be the responsibility of the owners of the 12 <br />lots adjacent to the Outlots.13 <br />It will be the City’s responsibility to maintain the bio-retention ponds for storm water purposes. 14 <br />This includes the cleaning of pipes and structures, repair and removal of sediment. It would also be 15 <br />the City’s responsibility to reconstruct the basins . These facilities are neces sary to meet Rice Creek 16 <br />Watershed District’s storm water treatment requirements and the City’s Green Infrastructure goals. 17 <br />The District requires the installation and maintenance of new storm water management facilities 18 <br />according to the district rules for city public works’ projects, including street re construction projects. 19 <br /> One of the permit requirements is to enter into a Maintenance Agreement covering the maintenance 20 <br />of the new storm water management facilities. 21 <br />P OLICY O BJECTIVE 22 <br />The Public Improvement Easement and Maintenance Agreement defines the future maintenance 23 <br />responsibilities for the landscaping being installed on the site between the property owners and the 24 <br />City of Roseville. 25 <br />The RCWD Maintenance agreement will cover the st orm water management facilities constructed in 26 <br />association with this project. Maintenance of storm water facilities is required by our Minnesota 27 <br />Pollution Control Agency Storm Water Pollution Prevention Permit (SWPPP). It is also consistent 28 <br />with our Public Works Policies to adequately maintain infrastructure. 29
