These improvements, shown in Attachment <br />C, would be made on the applicant’s property and be owned by the applicant. With <br />approval of the proposed INTERIM USE conditioned on continuing to work with <br />Engineering staff in implementing specific storm water mitigation measures to <br />address the storm water issues, the Planning Commission finds that the proposed <br />temporary classroom structure as an INTERIM USE would not be injurious to the <br />surrounding neighborhood or otherwise harm the public health, safety, and general <br />welfare. <br />In any case, if an approved INTERIM USE fails to conform to any of these requirements or <br />conditions of the approval and such problems are not or cannot be reasonably resolved, <br />the City may initiate a public hearing process to revoke the approval. <br />5.4 Because Roseville’s comprehensive plans and zoning code guide and regulate the <br />property for institutional development like the existing church and school, a permanent <br />expansion which conformed to the applicable design standards wouldn’t require this kind <br />of special review and approval. The reason for the INTERIM USE application is that the <br />temporary structure would not meet the standard design requirements. <br />5.5 If the proposed INTERIM USE is approved, all improvements will be required to adhere to <br />all applicable building code. Planning Division staff would recommend that all <br />improvements adhere to the applicable INST zoning requirements except for those <br />pertaining to the temporary nature of the structure and the design standards. <br />6.0 P UBLIC C OMMENT <br />6.1 As of the time this report was prepared, Pla nning Division staff received one letter from a <br />neighboring property owner, which is included with this report as Attachment D. The <br />duly-noticed public hearing for this application was held by the Planning Commission on <br />August 7, 2013; draft minutes of that public hearing are included with this report as <br />Attachment E. After reviewing the staff report and supporting documentation prepared <br />for the application and receiving additional public testimony, the Planning Commission <br />voted unanimously (i.e., 5 – 0) to approve th e proposed temporary classroom structure as <br />an interim use, subject to conditions, as provided in the detailed recommendation below. <br />6.2 The Public Works Department has a proposed storm water management project that is <br />unrelated to the proposed INTERIM USE . City staff is working with representatives of <br />Corpus Christi on these potential improvements that could alleviate some of the drainage <br />issues in the Fairview Avenue corridor. Concepts include regrading the existing swale <br />along the property line between the church and the backyards and constructing a rate <br />control pond. A project is in preliminary plan stages and not scheduled for construction .
