The location of the property adjacent to County Road C and across from a light <br />industrial area and the rail line adversely impacts the privacy of the applicant and his <br />family. <br /> <br />3. The character of the parcel (through lot) creates a practical difficulty for the applicant. <br /> <br />4. The proposed 6-1/2 foot tall fence will not impact sight lined at the intersection of <br />County Road C and Sheldon Street. <br /> <br />5. None of the adjacent properties (this one included) face County Road C; therefore, the <br />fence will not impact front yard views. <br /> <br />6. The proposed variance in is harmony with the general purpose and intent ofthe City's <br />Comprehensive plan and Title 10 (zoning) ofthe City Code. <br /> <br />7. The variance will not adversely affect the public health, safety, or general welfare. <br /> <br />Conditions: <br /> <br />1. The fence shall be limited to 6-1/2 feet in height. <br />2. The fence shall be located in the exact location as the existing white picked fence. <br /> <br />WHEREAS, the Roseville City Council received the Planning Commission's <br />recommendation on Tuesday, June 27, 2000; and <br /> <br />WHEREAS, the Roseville City Council made the following findings: <br /> <br />1 Section 1012.02B2 (Required Yards & Open Spaces) stipulates that fences in front yards <br />shall be limited to four feet in height. <br /> <br />2 The property located at 2655 Sheldon Street has two front yards, one located along Sheldon <br />Street and the other along County Road C. <br /> <br />3 A variance requires the applicant to prove physical hardship and to demonstrate that no <br />practical alternatives exist that would reduce the need for a variance. <br /> <br />4 The unique location of the property adjacent to County Road C, a rai/line, and across from <br />industrial uses adversely impacts the privacy and safety of the applicant and his fami/y. <br /> <br />5 The hardship is not the applicant's creation. <br /> <br />6 The property cannot be put to a reasonable use if used under the conditions permitted by the <br />ordinance. A four-foot high fence would not provide adequate screening from County Road <br />C, the rai/line, and adjacent industrial uses. <br /> <br />~ <br />
