RLjAse�f h� REQUEST FOR COUNCIL ACTION Date: 10/28/13 Item No.: 7.e Department Approval City Manager Approval Item Description: Consider a Resolution to Accept a Gift of Real Property at XXXX Lake St. from the Miley Estate 1 BACKGROUND 2 In 2012 staff was contacted by the Eilleen G. Miley estate trustees as to whether the City of 3 Roseville would be interested in receiving a gift of real property in southwest Roseville. The 4 property is entirely within the shoreline of Walsh Lake near Midland Hills Country Club. The E city's storm sewers drain to Walsh Lake and the city controls the elevation of Walsh Lake for o storm water purposes. City staff has worked with the City Attorney who has worked closely with 7 the Miley Trust's attorney to allow for the gifting of the property to the City of Roseville for storm 8 water purposes. The City has ownership of the other lots that lie within Walsh Lake that are a part 9 of this block as platted. The City Attorney has drafted a resolution for acceptance of the property 10 (Attachment A). We have also attached a map showing the location of the property (Attachment 11 B). 12 POLICY OBJECTIVE 1 %,, The City maintains a system of storm water drainage facilities to minimize risk of flooding of 14 private properties. The city maintains easement or ownership of wetlands and ponds that are a part JP of the city's drainage system. le, FINANCIAL IMPACTS 17 There would be no significant financial impact due to the acceptance of the gift of real property. 18 STAFF RECOMMENDATION Staff recommends the City Council accept the gift of property from the Miley Estate. 2c REQUESTED COUNCIL ACTION 21 Approve a resolution accepting the gift of real property described as Lot 19, Block 2, Garcelon's 22- Addition to Saint Paul from the Miley Estate. 2'23' Prepared by: Duane Schwartz, Public Works Director Attachments: A: Resolution B: Map Page 1 of 1
