Miley and Nancy E. Wenkel, as personal representatives of the <br />Estate of Eileen G. Miley, a /k /a Eileen Genevieve Miley, and Timothy G. Miley and Nancy E. <br />Wenkel, as trustees of the Eileen Miley Trust dated May 24, 1993, as amended, desire to give <br />and convey to the City of Roseville fee simple ownership to real property located within the <br />City legally described as follows: <br />Lot 19, Block 2, Garcelon's Addition to Saint Paul ( "Property "); and <br />WHEREAS, Minnesota Statutes § 465.03 authorizes the City to accept a gift of real property <br />by a Resolution of the City Council adopted by a two - thirds majority vote of its members; and <br />WHEREAS, the Roseville City Council has determined that acquiring fee simple ownership <br />of the property would be beneficial to the City, that it would be in the best interest of the City <br />to accept the gift of said real estate, and as a result thereof it desires to acquire said real <br />property; and <br />WHEREAS, the Roseville City Council has dispensed with the requirements of Minnesota <br />Statutes § 462.356, Subd. 2, that require the Roseville Planning Commission to conduct a <br />Comprehensive Plan compliance review of said property acquisition because it finds that the <br />proposed acquisition has no relationship to the Roseville Comprehensive Plan; <br />NOW, THEREFORE, BE IT RESOLVED that the Roseville City Council, on behalf of the <br />City of Roseville, hereby accepts the gift of the Property described herein. <br />The motion for the adoption of the foregoing resolutions was duly seconded by <br />Councilmember , and upon vote being taken thereon the following voted in favor <br />
