40 under Minnesota Statutes Chapter 429, and all rights to appeal in the courts. Should the <br />41 Assessment Amount exceed $160,000 by fifteen percent (15 %), demolition of the Buildings <br />42 shall not proceed without written approval of the excess costs by the Owners. <br />43 3. Payments. The voluntary assessments will be spread over twelve (12) years with a two - <br />44 year repayment deferral with no interest accruing and ten (10) year repayment schedule <br />45 beginning in 2014. Interest shall accrue starting in 2014 at the rate of six percent (6 %) per <br />46 year on the unpaid balance of the Assessment Amount. If the Owners fail to make any <br />47 payment of the Assessment Amount when due, the City may take all necessary enforcement <br />48 action, including the right to impose penalties and interest and to commence judicial action <br />49 to collect the payment. <br />50 3. The City Manager shall forthwith prepare and transmit to the County Auditor a certified <br />51 duplicate of the assessment roll, with each installment and interest on each unpaid <br />52 assessment set forth separately, to be extended upon the property tax lists of the <br />53 County, and the County Auditor shall thereafter collect such assessments in the manner <br />54 provided by law. <br />55 <br />56 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Roseville, <br />57 Minnesota: <br />58 <br />59 The motion for the adoption of the foregoing resolution was duly seconded by Member <br />60 and upon vote being taken thereon, the following voted in favor thereof: <br />61 and the following voted against the same: <br />62 <br />63 WHEREUPON said resolution was declared duly passed and adopted. <br />
