Attachment C <br />EXTRACT OF MINUTES OF MEETING <br />OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />1 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />2 of Roseville, County of Ramsey, Minnesota, was duly held on the 18th day of November, <br />3 2013, at 5:30 o'clock p.m. <br />4 <br />5 The following members were present: and the following were absent: . <br />6 <br />7 Councilmember introduced the following resolution and moved its adoption: <br />8 <br />9 RESOLUTION No. <br />10 <br />11 RESOLUTION ADOPTING AND CONFIRMING <br />12 2013 ASSESSMENTS FOR CITY PROJECT M- 12 -21: <br />13 PIKOVSKY TERMINAL DEMOLITION <br />14 <br />15 WHEREAS, pursuant to proper notice duly given as required by law, the council has met and <br />16 heard and passed upon all obj ections to the proposed assessment for City Proj ect M- 12 -21: <br />17 Pikovsky Terminal Demolition; <br />18 <br />19 BE IT RESOLVED by the Council of the City of Roseville, Minnesota as follows: <br />20 <br />21 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, <br />22 is hereby accepted and shall constitute the special assessment against the lands named <br />23 therein, and each tract of land therein included is hereby found to be benefited by the <br />24 proposed improvement in the amount of the assessment levied against it. <br />25 2. The proposed assessments are hereby adopted and confirmed as the proper special <br />26 assessments for each of said lots, pieces, or parcels of land, respectively, and the <br />27 assessment against each parcel, in accordance with the parties' mutual agreements <br />28 pursuant to the Settlement Agreement and Assessment Agreement dated June 18, 2012, <br />29 and as amended, true and correct copies of which are hereby attached as Exhibit A, to <br />30 wit: <br />31 2. Voluntary Assessment. The Owners voluntarily agree to an assessment of all of the <br />32 costs associated with the demolition of the Buildings, which may include, but are not <br />33 limited to pre- demolition building surveys, engineering reports, bidding package <br />34 preparation, associated city staff time, and actual demolition costs ( "Assessment Amount ") <br />35 against the Property. The Assessment Amount shall be assessed against the Property <br />36 without the necessity of any public hearings or other applicable assessment proceedings <br />37 under Minnesota Statutes Chapter 429. The Owners expressly waive objection to any <br />38 irregularity with regard to the said assessments and any claim that the amount thereof levied <br />39 against the Property is excessive, together with all rights to any proceedings or hearings <br />
