Monthly rental during such Annual Terms shall be equal to the Dent paid for the last month of <br />the final Renewal Term. If Lessee remains in possession of the Premises after the termination <br />of this Lease, then Lessee will be deemed to be occupying the Premises on a month-to-month <br />basis (the "'Holdover Terra" ), subject to the terms and conditions of this Lease. The Initial <br />Tenr . any Renewal Terms, any Annual Tens and any Holdover Term may be referred to <br />collectively as the ` Ferm." <br />Rent. <br />(a) On the Commencement lute the Lessee shall pay Owner, as rent, the sum of Twenty -line <br />Thousand and 1o10 Dollars ($29,000.00) per year, payable in advance in equal monthly installments of Two <br />Thousand Four Hundred Sixteen and 67/100 Dollars (2,416.67) " lent" . Lessee's first installment of lent shall be <br />prorated for any partial month and be paid to Owner within thirty days after the Commencement hate, and all <br />subsequent payments will be made in advance on or before the 1' day of each month. <br />(b) In year two of the Initial. Term and each year thereafter, including through any Renewal Terms <br />exercised, the .ent shall be increased y o per over the lent paid during the previous gear. <br />(c) Lessee may not add on the Tower additional equipment and/or antennas from that shown in Exhibit <br />B without approval of Owner, not to be unreasonably withheld, conditioned, or delayed and an addendum <br />agreement for additional rent. <br />(d) If the Lease is terminated, rent shall be pro -rated to the termination date. <br />All charges payable under this Lease, such as utilities and taxes, shall be bided by Owner within one 1 <br />year from the end of the calendar year in which the charges were incurred; any charges beyond such period shall <br />not be billed by Owner, and shall not be payable by Lessee. The foregoing shall not apply to monthly rent which is <br />due and payable without a requirement that it be billed by Owner. The provisions of this subsection shah survive <br />the termination or expiration of this Lease. <br />4. Property Use. Lessee may use the Premises for the installation, operation, repair, replacement, upgrade and <br />maintenance of facilities for the transmission and reception of radio communications signals in such frequencies as <br />may be assigned to Lessee by the Federal Communications Commission (the `FCC" ) and for the installation, <br />operation, maintenance and use of related equipment in accordance with the terms of this Lease. The lease of the <br />Property shall be non - exclusive. Lessee shall use the Property in compliance with all federal, state, and local laws <br />and regulations. Owner agrees to reasonably cooperate with the Lessee in obtaining, at Lessee's expense, including <br />the reimbursement of Owner's reasonable attorney and administrative fees at a cost not to exceed $500.00, all <br />federal licenses and permits required for Lessee's use of the Property. <br />5. Installation of Equipment and Leasehold Improvements. <br />a Lessee shall have the right, at its sole cost and expense, to erect, install, operate on the Premises, an <br />maintain the same in compliance will all applicable FCC rules and regulations, the necessary <br />equipment, personal property, and facilities which include radio transmitting and receiving antennas <br />not to exceed that designated in Exhibit B (the "Antenna Facilities"). <br />b Lessee's installation of all such Antenna Facilities shall be done according to plans approved by <br />Owner, which approval shall not unreasonably be withheld, conditioned, or delayed. Owner shall <br />approve or object to such Plans within days of receipt, and any failure to make objection within <br />said clays shall be deemed approval by Owner. Any damage done to Owner's Property during <br />installation or operations shall be repaired or replaced at Lessee's expense and to Owner's reasonable <br />satisfaction. <br />c Lessee shall provide Owner with a Site Plan to be attached hereto as Exhibit B, which shall include a <br />description of the equipment and personal property to be installed initially by Lessee. <br />
