Regular City Council Meeting <br /> Monday, February 10, 2014 <br /> Page 7 <br /> At the request of Mayor Roe, Mr. Miller advised that the JLEC was taking action <br /> on this agreement at their meeting this week as well; and by adding a specific <br /> time frame for termination, he didn't see any major problem with that body in <br /> their approval. <br /> Councilmember Willmus opined that he was more comfortable with a specific <br /> termination date at the onset of the agreement; and if it was necessary to continue <br /> the contract, it would then come back to the City Council for review and consid- <br /> eration of further extensions. <br /> Councilmember McGehee questioned the rationale in having the agreement come <br /> back before the City Council in two years, as long as the rates were adjustable and <br /> it would continue to work financially for the City. <br /> Councilmember Willmus responded that it was not his understanding that this was <br /> intended to be an ongoing item, but with the contract drafted as it is currently, it <br /> could be; and he thought the contract should be returned to the City Council for a <br /> review before extending it beyond two years. Councilmember Willmus further <br /> opined that the City had some exposure (e.g. Workers Compensation for employ- <br /> ee travel, etc.). <br /> Mayor Roe noted that the exposure for employees was no different whether for <br /> two days or two years; to which Councilmember McGehee concurred. <br /> In Section 11.2 (Financial Terms and Payment Process), Councilmember Laliber- <br /> te questioned the "additional task orders" listed and lack of agreed-upon amount <br /> for those services if needed. <br /> Mr. Miller responded that Attachment B included a sample task order; and how <br /> those services were structured would depend on which employees were assigned <br /> to the task. Mr. Miller assured the City Council that those rates would cover costs <br /> for employee health care benefits and any overhead costs. <br /> At the request of Councilmember Laliberte, Mr. Miller advised that the rates for <br /> 2014 were proposed to remain static, and if the project went into the 2015 budget <br /> yet, those costs would be revised upward as applicable to cover actual costs. <br /> Willmus moved, Laliberte seconded, amendment to the termination clause for a <br /> date specific to terminate the contract by January 1, 2016. <br /> Roll Call <br /> Ayes: Willmus; Etten; Laliberte; and Roe. <br /> Nays: McGehee. <br /> Motion carried. <br />
