Updated 3/6 <br /> R)segibhE <br /> REQUEST FOR COUNCIL ACTION <br /> Date: 03/10/2014 <br /> Item No.: 11.b <br /> Department Approval City Manager Approval <br /> Item Description: Public Hearing to Approve/Deny an On-Sale and Sunday Intoxicating Liquor <br /> License and Outside Sales and Consumption Endorsement for Digby's Roseville, <br /> LLC located at 854 Rosedale Center#1010. <br /> 1 BACKGROUND <br /> 2 Under City Code, a public hearing is required to consider approving liquor licenses for the current <br /> 3 calendar year. The City has received an application for a 2014 Liquor License as follows: <br /> 4 <br /> 5 ❖ Digby's Roseville, LLC—On-Sale and Sunday Intoxicating Liquor License <br /> 6 ❖ Digby's Roseville, LLC—Outside Sales and Consumption Endorsement <br /> 7 <br /> 8 The endorsement will be for the sale and consumption of alcoholic beverages outside of the licensed <br /> 9 premises. Digby's is allowed by Rosedale Mall to utilize the concrete area just outside their private <br /> I s entrance for seasonal outdoor seating. <br /> 12 Neither State Statute nor City Code limits the number of licenses that can be issued for On-Sale and <br /> 13 Sunday Intoxicating Liquor licenses. <br /> 14 <br /> 15 POLICY OBJECTIVE <br /> 16 The regulation of establishments that sell alcoholic beverages has been a long-standing practice by the <br /> 17 State and the City. <br /> 18 FINANCIAL IMPACTS <br /> 19 The revenue that is generated from the license fees is used to offset the cost of police compliance <br /> 20 checks, background investigations, enforcement of liquor laws, and license administration. <br /> 21 STAFF RECOMMENDATION <br /> 22 The applicant meets all requirements set forth under City Code.
