Councilmember-Initiated Items for Future Meetings <br /> Councilmember Laliberte asked for an update on the litigation and appeal recently dis- <br /> missed by the appellate court; and questioned whether that information had sufficiently <br /> filtered back to the community given the amount of public discussion the issue had re- <br /> ceived. <br /> City Attorney Mark Gaughan provided a brief review, noting that some matters had come <br /> before the City Council in November of 2013 related to the transfer and renewal of a liq- <br /> uor license, with the City Council ultimately approving both for the applicant, Total <br /> Wine. Mr. Gaughan noted that the decision had subsequently resulted in other interested <br /> parties bringing legal action seeking a review by the Court of Appeals of that City Coun- <br /> cil decision; with the appellate court dismissing that legal action based on a determination <br /> that they had no legal standing to request such a review. Mr. Gaughan advised that the <br /> party now had thirty days from that judge's decision to submit their appeal to the Minne- <br /> sota Supreme Court for review. Mr. Gaughan advised that, to-date, his calendar indicated <br /> nothing had been filed at this point. <br /> At the request of Councilmember McGehee, Mayor Roe advised that future discussions <br /> of water and sewer lines and responsibilities would be part of a broader policy discussion <br /> for base rates. <br /> Mr. Trudgeon concurred, advising that he needed to check with staff to determine when <br /> they could have the information and a report ready for the City Council. <br /> For the record, Mayor Roe opined that it was fair to state that Roseville was not unique in <br /> its approach for City versus resident water line ownership in the State or Country; and <br /> noted the number of communities dealing with similar issues. Mayor Roe noted that the <br /> City Council and its staff was trying to assist people as much as possible to find resolu- <br /> tion to problems created over these unusual winter months and long-term low tempera- <br /> tures. <br />
