BACKGROUND <br /> <br />Mr. Roberts owns an industrial building on the south side of <br />Terminal Road (old County Road B-2) at Long Lake Road. When the <br />new B-2 Bridge was built a few years ago, the alignment of <br />Terminal Road in this area was altered, allowing it to swing north <br />to line up with the new bridge crossing over I-35W. Because of <br />this angled alignment, the City purchased more property than was <br />needed for the roadway, leaving a triangular-shaped remnant in <br />front of Mr. Roberts I building. Because of this unusual <br />arrangement, Mr. Roberts is claiming a loss of visibility for his <br />building and is requesting a variance to allow an easement for a <br />pylon sign to be placed in the right-of-way at a location similar <br />to what would be allowed if Terminal Roàd had a standard 80'-wide <br />right-of-way. <br /> <br />Because the City has been negotiating wi th Mr. Roberts for over <br />two years regarding the situation, the city Council considers <br />this application to be exempt from the moratorium on sign <br />variances adopted last Dece~ber, and has referred it to the <br />Planning commission for a recommendation. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />Comprehensive Plan & Zoninq Code References <br /> <br />The property is guided Industrial and zoned 1-1. <br />building is consistent with the zoning. <br /> <br />The use of the <br /> <br />section 14.040 of the Code states that "signs shall not be <br />permitted within the public right-of-way or easements", with a few <br />exceptions, such as street signs. Business signs are not <br />allowed. The variance request is to this provision of the Code. <br />
