<br />Donald Roberts, Case No. 2143 <br /> <br />paqe 2 <br /> <br />The Code allows pylon signs in the 1-1 District to be 25' in <br />height and 100 square feet in area, set back 40' from the front <br />lot line. The proposed sign is 24' tall and 100 square feet in <br />area. <br /> <br />size & Location <br /> <br />The proposed sign meets the standards in the Code in terms of size <br />and height. It is proposed to be located 80' back from the <br />centerline of Terminal Road (54' from the curb) which is <br />equivalent to a 40' setback from a typical 80'-wide right-of-way, <br />as illustrated on the attached drawings. <br /> <br />3. CONCLUSION & RECOMMENDATION <br /> <br />The situation facing Mr. Roberts' property is clearly unusual and <br />creates a hardship for normal business operation. This area of <br />the City will probably be part of an eventual redevelopment <br />effort, in which case the excess right-of-way would be assembled <br />with the Roberts property, and the variance for this sign would no <br />longer be needed. <br /> <br />We recommend approval of the variance request with the condition <br />that, if and when the the Roberts property is sold for <br />redevelopment, the City be able to remove the sign, with no <br />additional compensation to Mr. Roberts or the owner at that time. <br />
