BACKGROUND <br /> <br />This is a request for street vacation due to the need to rebuild an old <br />garage on the property that was severely damaged when a tree fell on <br />it during a wind storm. When the owner came in to discuss the <br />requirements for securing a building permit for a new garage, it was <br />determined that the old garage was actually located on the ROW for <br />Owasso Boulevard South. After discussing this matter, staff directed <br />the property owner to retain a land surveyor to accurately locate the <br />right-of-way line and existing and proposed garages. <br /> <br />A copy of this survey has been attached for your review. This survey <br />shows that the traveled roadway does not coincide with the platted <br />ROW. As Mr. Fenner describes in his narrative, the portion of ROW <br />adjacent to the existing garage contains a steep slope with some 22 <br />feet of grade change. Both the top of the bank and the bottom of the <br />slope are shown on the survey, as is the guard rail that separates the <br />traveled surface of the road from the steep slope. <br /> <br />The Planning Commission should also be aware that Owasso Boulevard <br />South is a county road and that the Ramsey County Board will also <br />need to approve this vacation before it can finally occur. It is <br />interesting to note that the Engineering Department's records indicate <br />that the Ramsey County Highway Department is cal1íng for an <br />additional 10 feet of ROW in this area. <br /> <br />It is doubtful that Ramsey County really has plans to expand this <br />roadway and even more unlikely that if it were upgraded, it would <br />follow the platted ROW. This is due to both the topography and the <br />pattern of existing development in the area. In situations such as this, <br />we recommend that the City review the request from the perspective of <br />its own needs, while acknowledging Ramsey County's position in the <br />matter. <br /> <br />2.
