The garage that was damaged <br />by the storm was a nonconforming use and the subject of its location <br />would not have even come up if it had not been destroyed by a storm. <br /> <br />The location for the new garage will be located a couple of feet <br />further into the lot. However, the code requires a 3D-foot setback <br />from the front lot line for garages or houses, thus, this location will <br />require a variance. <br /> <br />The area that is proposed for vacation is delineated with the dark lines. <br />It contains 879 square feet of area. <br /> <br />Review of the attached location maps will provide the best illustration <br />of why it is unlikely that the section of ROW, requested for vacation, <br />will be needed in the future. As you will note, a portion of the ROW <br />has already been vacated. It is the portion that parallels the Fenner <br />property between the railroad ROWand Lake Owasso. All of the lots <br />that lie to the east of the Fenner property gain access via an unplatted <br />driveway. As these lots proceed to the east, they continue to get <br />smaller with less and less depth until this point of land ends at the <br />railroad bridge. The eastern extension of Owasso Boulevard occurs <br />about 1/4 mile to the south. <br /> <br />Engineering Considerations <br /> <br />This property was not assessed for the total frontage for water or <br />sanitary sewer. There is an additional $530.48 assessment pending for <br />this lot. <br /> <br />A driveway permit is need from both Ramsey County and the City of <br />Roseville. <br /> <br />3. CONCLUSION <br /> <br />From all indications, the basic alignment for Owasso Boulevard South <br />appears set and it would appear very unlikely that the portion of <br />platted ROW included in this request will ever be needed for roadway <br />purposes. The location that the Fenner's have selected for their <br />proposed garage appears reasonable in light of the conditions on the lot, <br />although technically this location will require a variance. Before the <br />street vacation can be finalized, Ramsey County will also need to <br />approve the request. <br />
