CONCLUSION AND RECOMMENDATION <br /> <br />If the bus company is proposed as a permanent long-term <br />use, it should be developed in accordance with current <br />zoning standards. The proposed three-phase approach <br />appears adequate to accomplish this. Obviously, one of <br />the key questions is what is a reasonable time period and <br />what should be the circumstances that trigger compliance. <br />We have suggested some time periods in the conditions that <br />follow, but want the Planning commission and the applicant <br />to comment on the timing issue as well. Whatever the <br />phasing ultimately agreed to, we feel strongly that there <br />should be specific dates or specific actions that dictate <br />the improvement of the site. <br /> <br />We therefore recommend <br />recommend approval of the <br />following conditions: <br /> <br />denial of <br />Special <br /> <br />the variances, <br />Use Permit with <br /> <br />but <br />the <br /> <br />1) Approval by City staff of detailed information to <br />be supplied by the applicant on proposed site <br />lighting in each phase. <br /> <br />2) The site plan will be revised to provide a total <br />of four handicapped parking spaces on site. <br /> <br />3) Additional landscaping will be provided in Phase <br />III, to include an additional overstory tree along <br />Arthur Street and additional landscaping in the <br />parking lot outside the fenced area on the east side <br />of the site. <br /> <br />4) Phase I improvements will be impelemented <br />immediately, Phase II improvements will be <br />implemented when the City acquires Arthur Street <br />right-of-way, and Phase III improvements will be <br />implemented when Arthur Street is built and open for <br />use. <br /> <br />5) The entire building shall be painted in an <br />attractive manner in Phase I, with plans prepared and <br />approved by City staff to bring the building <br />completely up to Zoning Code design standards within <br />three years after the completion of Arthur Street, or <br />within three years after a specific decision by the <br />City council that Arthur Street will not be acquired <br />and built. <br /> <br />6) In the event that the City decides not to acquire <br />and build Arthur Street, the applicant shall prepare <br />and implement a site plan to be approved by City <br />staff, removing all parking within a 15' landscaped <br />
