<br />Points for Agreement with Tanurb <br /> <br />1. The agreement should be conditioned upon completion of the <br />fence as shown in Attachment A. <br /> <br />2. The cost of the construction of the fence should be shared <br />between the City and Tanurb based on the following <br /> <br />a. Tanurb would pick up the first $10,000 of the cost of <br />the fence provided they do not have to provide the <br />brick screen wall adjacent to the loading dock area on <br />the north side of the center. <br /> <br />b. The remainder of the cost would be split on a 50/50 <br />basis between the City and Tanurb with the provision <br />that the additional costs to Tanurb shall not exceed <br />$30,000. <br /> <br />3. Tanurb will assume all maintenance and liability of the <br />fence, both during and after the fence is constructed. <br /> <br />4. The construction of the fence will be contingent upon the <br />city granting variances to Tanurb Corporation to allow for <br />the elimination of the brick screen wall adjacent to the <br />loading dock area. <br />
