<br />DECLARATION <br />OF <br />COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS <br /> <br />THIS DECLARATION is made on this <br />by The Rottlund Company, Inc., a Minnesota <br />to as ·Declarant·). <br /> <br />day of <br />corporation <br /> <br />(hereinafter <br /> <br />, 19_, <br />referred <br /> <br />RECITALS: <br /> <br />A. Declarant is the owner of certain real property described on Exhibit <br />A attached hereto and by this reference incorporated herein, being located in <br />the City of Roseville, County of Ramsey, State of Minnesota (the ·Property·). <br /> <br />B. Declarant desires to subject the Property to the covenants, <br />restrictions. easements, charges and liens hereinafter set forth. <br /> <br />C. <br />unde r the <br />Association <br />set forth. <br /> <br />Declarant has caused to be incorporated as a non-profit corporation <br />laws of the State of Minnesota, Concordia Meadows Atrium Townhome <br />for the purpose of exercising the powers and duties hereinafter <br /> <br />NOV, THEREFORE, Declarant hereby declares that the Property shall be <br />held, built upon. sold, conveyed and occupied subject to the following <br />easements, restrictions, covenants. conditions. charges and liens which are <br />for the purpose of protecting the value and desirability of. and the benefits <br />and burdens of which shall run with. the Property and shall be binding on all <br />parties having any right. title or interest in the Property or any part <br />thereof, and their heirs. successors and assigns. <br /> <br />ARTICLE I <br /> <br />DEFINITIONS <br /> <br />Section 1. "Association" <br />Atrium Townhome Association, a <br />successors and assigns. <br /> <br />shall mean <br />Minnesota <br /> <br />and refer <br />non-profit <br /> <br />to Concordia Meadows <br />corporation. its <br /> <br />Section 2. "Owner" shall mean and refer to the holder of the fee simple <br />title to, to a contract for deed vendee of, or to any life tenant or lessee of <br />a lease having a term of more than three years in, any Lot which is part of <br />the Property. or any combination thereof. whether one or more persons or <br />entities, but excluding contract for deed vendors and others having such <br />interest merely as security for the performance of an obligation. <br /> <br />Section 3. "Property" shall mean and refer to that certain real property <br />hereinbefore described, and such additions thereto as may hereafter be brought <br />within the jurisdiction of the Association in accordance with the provisions <br />hereof. <br />
