<br />Section 4. "Private Yard Area" shall mean and refer to that portion of a <br />Lot not covered by a Living Unit or by a Semi-Private Driveway. <br /> <br />Section 5. "Semi-Private Driveway" shall mean and refer to access <br />driveways from public streets to the Living Units and adjoining parking areas. <br /> <br />Section 6. "Living Unit" shall mean and refer to the improvements <br />located on any Lot designed for use as a single-family dwelling unit. <br /> <br />Section 7. "Lot" shall mean and refer to any plot of land shown upon any <br />recorded plat of the Property and shall, when the context hereof requires, <br />include any improvements thereon. <br /> <br />Section 8. "Declarant" shall mean and refer to The Rottlund Company, <br />Inc., a Minnesota corporation, its successors and assigns if (i) any such <br />successor or assign should acquire more than one undeveloped Lot from the <br />Declarant for the purpose of development and the instrument of conveyance <br />recites that such successor or assign has acquired all of the rights and <br />obligations of the Declarant; or (ii) such rights and obligations pass to such <br />successor or assign by operation of law. <br /> <br />Section 9. "Declaration" shall mean and refer to this Declaration of <br />Covenants, Restrictions, Conditions and Easement as from time to time amended <br />in accordance with the provisions hereof. <br /> <br />ARTICLE II <br /> <br />MEMBERSHIP AND VOTING RIGHTS <br /> <br />Section 1. Every Owner of a Lot which is subject to assessment by the <br />Association shall be a member of the Association. Membership shall be <br />appurtenant to and may not be separated from ownership of any Lot which is <br />subject to assessment by the Association. <br /> <br />Section 2. The Association shall have two (2) classes of membership, <br />Class A and Class B as follows: <br /> <br />Class A. Class A members shall be all Owners, with the <br />exception of Class B members, if any, and shall be entitled on all <br />issues to one vote for each Lot owned. When more than one person <br />holds an interest in any Lot, all such persons shall be members. <br />The vote for such Lot shall be exercised as they determine, but in <br />no event shall more than one vote be cast with respect to any Lot. <br /> <br />Class B. Class B member(s) shall <br />succeeding to the rights of Declarant <br />Section 8 of this Declaration and shall be <br /> <br />be Declarant and persons <br />as provided in Article I, <br />entitled to three (3) <br /> <br />-2- <br />
