Regular City Council Meeting <br /> Monday,March 24,2014 <br /> Page 45 <br /> If this ordinance is adopted, Ms. Elkins suggested at a minimum a sunset provi- <br /> sion for the police department to review in six months to determine if the APS <br /> claim for recovery of stolen property has worked. <br /> Frank Tilotta, Owner Music Go Round Roseville <br /> Mr. Tilotta referenced a newspaper article from the March 5, 2014 business meet- <br /> ing providing crime and delinquency statistics, and the conclusion of that article. <br /> Mr. Tilotta opined that underlying research and statistics and tracked transactions <br /> had proven minimal. <br /> Specific to his business, Mr. Tilotta opined that he would look to be exempt, as <br /> the proposed fee for his type of business didn't warrant the recovery rate, since <br /> there was no existing initial problem with stolen musical instruments. <br /> Richard Schwinden,Mr. Zeros in Roseville, 1744 Lexington Avenue <br /> Mr. Schwinden advised that he was the one who notified Half Price Books and <br /> others when his business received information and they did not, including other of <br /> his peers who were not contacted. Mr. Schwinden questioned why some busi- <br /> nesses had been excluded and not others. Mr. Schwinden advised that they had <br /> opened in Roseville specifically due to there being no used goods law in place, <br /> because in looking at other communities, they would not be able to operate and <br /> afford the fees, making it not feasible in the long-run. Having opened five years <br /> ago, Mr. Schwinden reviewed their typical business, including records, CD's, <br /> VHS tapes, posters and memorabilia, most without a skew or serial number avail- <br /> able to record; and the majority of those transactions very minor in nature. <br /> Mr. Schwinden agreed with the comments already expressed that this would <br /> grossly affect their business, and be tortuous interference; with their business ul- <br /> timately not succeeding if adopted. <br /> With no one else coming forward to speak, Mayor Roe thanked the audience for <br /> their public comment; and noted that this item is not being considered for action <br /> at this time, with staff asked to return with additional information as previously <br /> addressed and after the City Council has had time to consider the issue and verbal <br /> and written comments received from the public. Mayor Roe advised that staff <br /> would attempt to keep people informed of when this item may be back before the <br /> City Council for consideration and further discussion. <br /> 15.
