<br />August 15, 1991 <br /> <br />Rick Jopke <br />Planning and Zoning Administrator <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />RE: Bob and Peggy Slater's request for rezoning at the Lake Owasso Marina <br /> <br />As the City staff and Council Members consider the request for rezoning of the Lake Owasso <br />Marina, I would like to provide some comments and considerations. Eleanor Gillespie is the <br />owner of the lot directly north of the marina. Eleanor lives at 2800 Lakeview Avenue and has <br />been a resident of Roseville since 1957. I am her son-in-law and have been helping her on this <br />project. <br /> <br />As most of you are aware, we were involved in a legal process regarding the City's denial of <br />variances for our Owasso lot. The Court determined that since Eleanor had owned the lot since <br />1966, it was grandfathered in as a buildable lot both under State law and the Roseville City <br />Ordinance. We regret that the proceedings had to conclude in a legal action, however, we had <br />worked with the City staff and Council for over 2 1/2 years without any resolution. <br /> <br />Since receiving variances in October 1990, the lot has been listed for sale with Burnet Realty. <br />Of the inquiries we have had, several have expressed concern that the marina operations were <br />located adjacent to our lot. Since I was aware that the marina had just recently purchased their <br />northern lot, and that it was zoned residential, I called the City staff and asked that they enforce <br />the zoning ordinances. This eventually resulted in the Slater's request for rezoning. <br /> <br />In your consideration of the rezoning request, I would like to mention the following items: <br /> <br />The marina is a long-time business of Roseville, however, their north lot was not <br />purchased until 1985. When I talked to Mr. Robbins (the owner of the. marina prior to <br />the Slaters) in 19S5"about purchasing Eleanor's lot, he said thát he was aware that his <br />north lot was zoned residential, but that he wanted it as a bùffer to the residential area <br />to the north. <br /> <br />A mistake was made in the Slater's purchase of the marina in that they were told that the <br />north lot was approved for marina operations. I have suggested to the Slaters that they <br />talk to Mr. Robbins about how the actual zoning differed from what was represented in <br />the purchase agreement between the Slaters and Robbins, but the Slaters responded that <br />they did not want to pursue that. <br /> <br />The realtor from Burnet has estimated that our lot value would be reduced by somewhere <br />around $20,000 if the zoning is changed. Although the exact amount is impossible to <br />determine, the amount would be significant. <br />
