<br />City of Roseville <br />Page 2 <br /> <br />The Council at its June 24th and August 12th meetings requested that the parties try to come to <br />a compromise. In general, the Slaters have proposed to build a fence along the property line, <br />plant three trees, not store boats within 70 feet of the property line and not park cars within 35 <br />feet of the property line. We have proposed that the fence be moved back 20 feet from the <br />property line and that we be given a purchase option for 15 feet of the marina's lot for $5,000 <br />or an easement for 15 feet for $2,000. The following comments are made relating to these <br />proposals: <br /> <br />One of our major concerns is the visual effect of the adjacent marina operations if the <br />zoning is approved. Although the Slater's proposal includes a buffer zone and a fence <br />between the two properties, both parties agree that this would not solve our screening <br />concerns. During our conversations, I proposed additional landscape screening besides <br />the three trees they had proposed, however, the Slaters felt that this would be too costly. <br />Since a house constructed on our lot would most 1ilœly be a walk-out style, the proposed <br />fence and three trees would have only a minimal effect. <br /> <br />The Slaters wrote in an August 3, 1991 letter to me that although they propose the 70 <br />feet and 35 feet buffer areas they dä1 intend to make use of their property, so the area <br />"will not be void of use". We have concerns on how effective this buffer would actually <br />be. <br /> <br />The Slaters said during the August 12th Council meeting that selling part of their <br />property probably would not work because Robbins had a contract for deed on the <br />property, and he may not approve the sale. The Slater's attorney told me that since <br />Robbins represented in the purchase agreement that their property was properly zoned, <br />he would mostly likely be receptive to a release request. <br /> <br />The Slaters told· me that they did not want to sell any marina property to us· because if <br />they subsequently sold the total marina to a developer that they would regret having sold <br />any property to us. I would hope that the concerns and issues we are discussing are the <br />marina operations and not future development possibilities. <br /> <br />Our lot is currently for sale for $864 per running foot. Our proposal to purchase part <br />of the marina's property equals $333 per running foot. The price for our lot is <br />significantly higher because it is the price for a whole residential lot on which a new <br />house can be constructed. Also, under our proposal, the cost of the additional landscape <br />screening would be paid by us and not by the Slaters. With large spruce trees costing <br />$500 each, the additional screening would be significant. <br />
