The City ordinances require that there be a 30 foot rear yard <br />setback in R-1 residential districts. <br /> <br />2. Eugene Roeller has requested a variance to the rear yard <br />setback requirements to allow him to construct a three season <br />porch on the rear of his existing dwelling. Because of the <br />irregular shape lot, one corner of the proposed addition would <br />have a setback of 28-1/2 feet instead of the required 30 feet. <br /> <br />3. The Minor Variance Committee unanimously recommended approval <br />of the request because there was a hardship presented by the <br />odd shape lot and because the encroachment is minor. <br /> <br />Alternatives: <br /> <br />1. Deny the variance and require that the addition be installed <br />in accordance with the ordinance. <br /> <br />2. Approve the variance as requested. <br /> <br />policv Obiectives: <br /> <br />1. To ensure that structures are built and maintained in <br />accordance with the City zoning ordinance. <br /> <br />Staff Recommendation: <br /> <br />1. It is recommended that the City council approve Eugene <br />Roeller's request for a minor variance at 2930 Merrill Street. <br /> <br />Council Action Reauested: <br /> <br />1. Motion to approve Eugene Roeller' s request for a minor <br />variance at 2930 Merrill Street. <br />
