BACKGROUND <br /> <br />Pastor Hicks lives in the home at 1746 Hamline owned by <br />the Nazarene Church. The south side of the lot abuts the <br />right-of-way for lone Street which is one lot deep, <br />between Hamline Avenue and the apartment property behind. <br />lone street is not built and is not needed, since the <br />apartments take their access off Dellwood Avenue. <br /> <br />The garage on this lot is on the south side of the house, <br />facing Ione, and was intended to have access onto lone. <br />Movements in and out of the garage to Hamline Avenue are <br />difficult. Hamline Avenue is being reconstructed this <br />summer, which will involve a new driveway opening for the <br />lot. Mr. Hicks is requesting a vacation of a 15 foot <br />wide portion of the Ione street right-of-way in order to <br />put in a new driveway that allows easier access to the <br />garage. <br /> <br />The request is reasonable, given the circumstances. We may <br />have wanted to vacate a somewhat larger piece of the <br />right-of-way in order to give the lot easier access, but <br />two issues arise. First, there is an existing storm sewer <br />in the lone right-of-way 20' south of the lot line. <br />Second, any additional vacated right-of-way will add <br />assessments to the lot. We want to keep this to the <br />absolute minimum required. <br /> <br />Code also requires that a driveway onto a County road, <br />such as Hamline, allow for cars to head out rather than <br />back out. In order to accommodate this movement and a 5' <br />driveway setback, the 15' requested is adequate, but not <br />generous. <br />
