If the agency is not a branch <br />of government under Minnesota law, the COUNTY may require the <br />AGENCY to furnish data, information, and assistance as <br />necessary to enable the COUNTY to comply with the State <br />Environmental Policy Act. <br /> <br />C. Satisfaction of Environmental Requirements. Project <br />execution under this Agreement by either the COUNTY or the <br />AGENCY shall not proceed until all applicable requirements of <br />the National and State Environmental Policy Acts have been <br />satisfied. The COUNTY will not issue a written notice to <br />proceed until all such requirements are met. <br /> <br />4. NON-DISCRIMINATION <br /> <br />A. General. The AGENCY shall comply with all federal, state, <br />and local laws prohibiting discrimination on the basis of <br />age, sex, marital status, race, creed, color, national origin <br />or the presence of any sensory, mental or physical handicap, <br />or any other basis nor or hereafter prohibited by law. These <br />requirements are specified in Section 109 of the Housing and <br />Community Development Act of 1974, as amended; Civil Rights <br />Act of 1964, Title VI, as amended; Civil Rights Act of 1968, <br />Title VIII, as amended; Executive Order 11063, as amended; <br />Executive Order 11246, as amended; Section 3 of the Housing <br />and Urban Development Act of 1968, as amended; and §504 of <br />the Rehabilitation Act of 1973, as amended, and implementi~g <br />regulations at 24 C.F.R. Part 8. Specifically, the AGENCY <br />shall comply with the requirements of 24 C.F.R. §92.350. <br /> <br />B. Fair Housing. The AGENCY shall take necessary and <br />appropriate actions to affirmatively further fair housing. <br />Actions enumerated at 24 C.F.R. §570.904(c) will satisfy this <br />requirement. <br /> <br />C. Employment. <br /> <br />1) In all solicitations under this Agreement, the AGENCY <br />shall state that all qualified applicants will be <br />considered for employment. The words "equal opportunity <br />employer" in advertisements shall constitute compliance <br />with this section. <br /> <br />2) The AGENCY shall not discriminate against an employee or <br />applicant for employment in connection with this <br />Agreement because of age, marital status, race, creed, <br />color, national origin, or the presence of any sensory, <br />mental or physical handicap, except when there is a bona <br />fide occupational limitation. Such action shall <br />include, but not be limited to, the following: <br />Employment, upgrading, demotion or transfer, recruitment <br />or recruitment advertising, layoff or termination, rates <br />of payor other forms of compensation, and selection for <br />training.
