<br />3) To the greatest extent feasible, the AGENCY shall <br />provide training and employment opportunities for lower <br />income residents within the area served by HOME projects <br />in accordance with the requirements of the Ramsey County <br />Section 3 Plan. As appropriate, the Section 3 Clause, a <br />copy of which is attached hereto as Attachment A and <br />made a part hereof, shall be included in contracts <br />between the AGENCY and contractors and subcontractors. <br /> <br />E. Contractors and Suppliers <br /> <br />1) <br /> <br />No contractor, subcontractor, union or vendor engaged in <br />any activity under this Agreement shall discriminate in <br />the sale of materials, equipment or labor on the basis <br />of age, sex, marital status, race, creed, color, <br />national origin, or the presence of any sensory, mental <br />or physical handicap. Such practices include upgrading, <br />demotion, recruiting, transfer, layoff, termination, pay <br />rate, and advertisement for employment. (Executive <br />Order 11246 as amended) <br /> <br />2 ) <br /> <br />All firms and organizations described above shall be <br />required to submit to the AGENCY certificates of <br />compliance demonstrating that they have, in fact, <br />complied with the foregoing provisions; provided, that <br />certificates of compliance shall not be required from <br />firms and organizations on contracts and/or yearly sales <br />of less than $10,000. <br /> <br />. <br /> <br />3) <br /> <br />To the greatest extent feasible, the AGENCY shall <br />purchase supplies and services for activities under this <br />Agreement from vendors and contractors whose businesses <br />are located in the area served by the HOME Program or <br />owned in substantial part by project area residents. <br /> <br />4) The AGENCY must make efforts to encourage the use of <br />minority and women's business enterprises in connection <br />with HOME funded activities in accordance with the <br />Ramsey County Targeted Vendor Development Program, <br />Resolution No. 90-621, as amended, and <br />24 C.F.R. §92.350(a)(4)(ii). <br /> <br />5. uæOR STMmMillS <br /> <br />Pursuant to the provlslons of 24 C.F.R. §92.354, for any Project <br />for the construction (rehabilitation or new construction) of <br />affordable housing with 12 or more units assisted with HOME <br />funds, the AGENCY shall require that project construction <br />contractors and subcontractors pay their laborers and mechanics <br />at wage rates in accordance with the Davis-Bacon Act, as amended <br />(40 U.S.C. §276a-5). Such contracts are also subject to the <br />overtime provisions, as applicable, of the Contract Work Hours <br />and Safety Standards Act, 40 U.S.C. §§327-332. <br /> <br />6. HOUSING QUALITY STANDARDS <br /> <br />Page -11- <br />
