3) To the greatest extent feasible, the AGENCY shall provide training and employment opportunities for lower income residents within the area served by HOME projects in accordance with the requirements of the Ramsey County Section 3 Plan. As appropriate, the Section 3 Clause, a copy of which is attached hereto as Attachment A and made a part hereof, shall be included in contracts between the AGENCY and contractors and subcontractors. E. Contractors and Suppliers 1) No contractor, subcontractor, union or vendor engaged in any activity under this Agreement shall discriminate in the sale of materials, equipment or labor on the basis of age, sex, marital status, race, creed, color, national origin, or the presence of any sensory, mental or physical handicap. Such practices include upgrading, demotion, recruiting, transfer, layoff, termination, pay rate, and advertisement for employment. (Executive Order 11246 as amended) 2 ) All firms and organizations described above shall be required to submit to the AGENCY certificates of compliance demonstrating that they have, in fact, complied with the foregoing provisions; provided, that certificates of compliance shall not be required from firms and organizations on contracts and/or yearly sales of less than $10,000. . 3) To the greatest extent feasible, the AGENCY shall purchase supplies and services for activities under this Agreement from vendors and contractors whose businesses are located in the area served by the HOME Program or owned in substantial part by project area residents. 4) The AGENCY must make efforts to encourage the use of minority and women's business enterprises in connection with HOME funded activities in accordance with the Ramsey County Targeted Vendor Development Program, Resolution No. 90-621, as amended, and 24 C.F.R. §92.350(a)(4)(ii). 5. uæOR STMmMillS Pursuant to the provlslons of 24 C.F.R. §92.354, for any Project for the construction (rehabilitation or new construction) of affordable housing with 12 or more units assisted with HOME funds, the AGENCY shall require that project construction contractors and subcontractors pay their laborers and mechanics at wage rates in accordance with the Davis-Bacon Act, as amended (40 U.S.C. §276a-5). Such contracts are also subject to the overtime provisions, as applicable, of the Contract Work Hours and Safety Standards Act, 40 U.S.C. §§327-332. 6. HOUSING QUALITY STANDARDS Page -11-
