<br />The AGENCY shall meet the historic preservation requirements of <br />Public Law 89-665 and the Archaeological and Historic <br />Preservation Act of 1974 (Pub. L. 93-291) and Executive Order <br />11593, including the procedures prescribed by the Advisory <br />Council on Historic Preservation in the Regulations at 36 C.F.R. <br />Part 800. Activities affecting property listed in or found to be <br />eligible for inclusion in the National Register of Historic <br />Places will be subject to the requirements of 24 C.F.R. Part 58. <br /> <br />14. ARCHITECTURAL BARRIERS <br /> <br />Any facility constructed pursuant to this Agreement shall comply <br />with design requirements of the Architectural Barriers Act of <br />1968 (42 D.S.C. Section 4151). <br /> <br />15. NON-PARTICIPATION IN POLITICAL ACTIVITIES <br /> <br />The AGENCY shall comply with the provisions of the Hatch Act (5 <br />D.S.C. Ch. 15). <br /> <br />16. CONDITIONS FOR RELIGIOUS ORGANIZATIONS <br /> <br />HOME funds may not be provided to primarily religious <br />organizations, such as churches, for any activity including <br />secular activities. In addition, HOME funds may not be used to <br />rehabilitate or construct housing owned by primarily religious <br />organizations or to assist primarily religious organizations in <br />acquiring housing. However, HOME funds may be used in accordaqce <br />with 24 C.F.R. §92.257. <br /> <br />17. NATIONAL FLOOD INSURANCE <br /> <br />The AGENCY may not receive HOME funds for acquisition or <br />construction in any area that has been identified as having <br />special flood hazards and is not participating in the National <br />Flood Insurance Program, as provided by Section 3(a) of the Flood <br />Disaster Protection Act of 1973 (Pub. L. 93-234) and the <br />Regulations thereunder (24 C.F.R. Ch. X, subchap. B). <br /> <br />18. AIR AND WATER POLLUTION <br /> <br />The AGENCY shall comply with the prov~s~ons of the Clean Air Act, <br />as amended (42 D.S.C. Section 1857 et seq.) and the Federal Water <br />Pollution Control Act, as amended (33 D.S.C. Sections 1251, et <br />seq.) and the regulations issued thereunder (40 C.F.R. Part 15). <br /> <br />19. LEAD-BASED PAINT POISONING <br /> <br />The AGENCY shall comply with the H.D.D. Lead-Based Paint <br />Regulations (24 C.F.R. Part 35) issued pursuant to the Lead-Based <br />Paint Poisoning Prevention Act (42 D.S.C. Sections 4831 et seq.) <br />requiring prohibition of the use of lead-based paint (whenever <br />funds under this Agreement are used directly or indirectly for <br />construction, rehabilitation, or modernization of residential <br />structures); elimination of immediate lead-based paint hazards in <br /> <br />Page -16- <br />
