Description: Partial release of easement over Calibre Ridge <br />Townhouse site <br /> <br />Background: The Calibre Ridge Townhouse site on Rice Street north of <br />T. H. 36 has had three different proposals for development over the past <br />four years. One of the proposed developers, Gordy Howe Real Estate, <br />Inc., proposed a site development which required the dedication of <br />additional utility easements to cover the proposed new sewer and water <br />lines as part of that proposal. The easement was prepared and on June <br />30, 1989, and recorded in the office of Ramsey County granting the <br />easement to the City of Roseville. The present proposal of Calibre <br />Ridge has a new alignment for the proposed utilities, and the previously <br />recorded easement would presently be located under the new proposed <br />building sites. A site plan shows this situation. <br /> <br />policy objectives: The city staff reviews proposed development project <br />to assure adequate easements and/or conflicts with existing easements <br />are addressed. A partial release of easement is required enabling the <br />proposed building sites to be constructed as shown on the approved <br />Calibre Ridge site without encroaching on an existing easement. <br /> <br />Financial i.plications: The city obtained the existing easement at no <br />cost to the city and any additional new easements needed for the <br />approved Calibre Ridge townhome site would be dedicated at no cost to <br />the city. <br /> <br />staff recommendation: Staff recommends a partial release of easement, <br />Document No. 2498693 recorded on Ju~e 30, 1989, which would remove that <br />portion of the easement which would lie under the proposed new <br />buildings. That portion of the easement still needed by the city for <br />the existing or proposed improvements would remain in effect. <br /> <br />RECOMMENDED COUBCIL ACTION: <br /> <br />Approval of motion for a partial release of easement, Document No. <br />2498693 dated March 9, 1989, be approved and authorizing staff to record <br />the partial release of easement at Ramsey County. <br />
