Specifically, you-~kedfor my op~ori about the feasibility of creating an <br />"open space district" that would presumably limit the permined uses. to very low intensity <br />uses, such as nature conservancy, ~ parks, etc:. <br /> <br />Let me begin by sayìng that it is myasswnption that we would only want to follow a <br />course that is clearly within the. City's statutory anthOI:'.ity_ That is simply to say that we <br />could obvíously C('eate an open space district with very restricted uses and the affected land <br />owners wcu.rld have to chall~nge it in dÎstrict court. This has never been the Cìty's style <br />and it would not be our :adyice to change that at ~ point. What then are the options? <br /> <br />I have had occ;a;ion to write someionîng district.$odan:Is for Conservancy Districts (CD) in <br />- both Mendota He~ts and BnrnsVille.. These disçricts fit exactly the nature of the type of <br />use limitations tha:t:.yPµ presented ~n the telephone, Craig- In both cases., however, the land <br />ha~ been purchased by either the.Sta.te or the Fecileral Government v.ith the express purpose <br />of preserving it for some natural conservancy reJ.a;ted reasons (Minnesota Valley Federal <br />Wildlife Refuge). In the absence of the clear intent by the land owner to use the land.in <br />such a manner; I believe it would not be held as reasonable to ZOne land for essentially no <br />productive use_ : : <br /> <br />It would be well within the City's authori~ to guide and zone these properties for less <br />intensÍVe use than the .current R-l-zonîng.. To-do this we would need to identify some <br />compreh.ensive p~g goals ~~ would be served by such a move., establish the "rational <br />basis", create the new district and proceed wÏth the rezoning. Although we would need to <br />be very careful in. establishing the comprehensive,planning framework to support this new <br />. . <br /> <br />.. <br />
