March 10, 1992

FROM:

steve Gatlin ~~~~
steve sarkoz~ -

TO:

SUBJECT:

WILLARD DD LOUISB GROVE, DOIDGB BASBMBIIT VACATION,
1975 NOR'l'B OXFORD STREBT

Attached is a letter received February 26 from Mr. and Mrs. Grove,
expressing concern about the process and cost of facilitating a
,drainage easement vacation that they suggest should have been the
city's responsibility some twenty years earlier. This issue
deserves our careful consideration and response.

Several questions come to mind prior to responding to the Groves:

o Does the City have other similar drainage easements
covering entire occupied and developed residential
lots? How many?

o Were other similar drainage easements routinely
vacated and, if so, what prompted the vacation
process in those instances?

o Do we have any existing City policies which address
vacating drainage easements which pre-existed resi-
dential property development?

Presumably the development of a single family home on a lot fully
restricted by a drainage easement should have been caught in the
building permit process. Are there any records on this or other
lots having a similar history? Please see me as soon as possible
.once these questions are fully researched. I would like to respond
to the Groves by the end of this week.

Thank you for your help in this matter.

Attachment
